Court day for 'Fort Dix Six'

Court day for 'Fort Dix Six'
After hearing, suspects headed back to jail

    WABC Eyewitness News Team

(New Jersey-WABC, May 11, 2007) - Bail was denied for one of the six Muslim immigrants charged with plotting to kill soldiers at Fort Dix, while attorneys for the other five agreed to keep them behind bars.
New Jersey reporter Anthony Johnson is live in Camden with the story.

The hearing started just after 10 o'clock this morning and lasted a little over an hour. The suspects were all brought to the U.S. District Court in Camden under heavy security in a black van with heavily tinted windows.

They were expected to leave the facility in the same van around noontime to return back to federal prison in Philadelphia.

The six defendants had their feet shackled and their hands were free, giving them a chance to wave to family members inside the courtroom.

Several women sobbed as each one came in to face the judge.

    Names of the Six Suspects:

    1. Mohamad Ibrahim Shnewer
    2. Dritan Duka
    3. Eljvir Duka
    4. Shain Duka
    5. Serdar Tatar
    6. Agron Abdullahu

A lawyer for Mohamad Ibrahim Shnewer argued for bail and family and friends were willing to put up the money or their property for collateral, but judge did not grant bail.

The judge said Shnewer was a flight risk and could be a danger to the community.

The mother of Mohamad Ibrahim Shnewer, says her son could not be a terrorist.

"He didn't have anything to do. He worked all night and come here like in the morning. Sleep and go back to work. This is his life," said Duka's mother through the front door of her house.

Another lawyer said this is going to be a very a very challenging case.

"It's a tough case because of the enormous, I don't want to say rush to judgement.....that most people have," said Defense Attorney Michael Reilly.

The families all tried to avoid the media as they entered and left the courthouse. The attorney for Eljvir Duka asked that his client be allowed to receive a copy of the Koran.

"He hasn't been provided his religious materials which he's asked for. So I'm going to go back to my office and try to address that and see if I can help him out that way," said Defense Attorney Troy Archie.

The six were arrested after a 15-month investigation that began when one of the suspects asked a Mount Laurel Circuit City employee to make a DVD of video tape depicting the men firing weapons while yelling for jihad. The clerk turned the tape over to authorities.

Abdullahu will return to court again on May 17, when his lawyer plans to request bail. The other suspects reserved the right to request bail at a later date.

Meanwhile the father of the Duka brothers has been placed in INS custody because he's an illegal alien.

In my jaded opinion, they shouldn't have had their hands free either.
