A man who was living in Peachtree City will spend 30 years in prison after a Fayette County jury found him guilty of raping a 19-year-old woman in her apartment.

Ulises Chavez was sentenced Monday morning to 20 years for rape and 10 years for burglary, consecutively, by Superior Court Judge Johnnie Caldwell.

It was brought out in the sentencing hearing that Chavez was in the country illegally. He apparently worked at a car wash and detail shop in Peachtree City, officials said.

A number of co-workers spoke out on his behalf at the sentencing.

The victim had testified last week that Chavez was the man who was having intercourse with her as she woke up in her bedroom early one August morning.

The victim said she had passed out after drinking at a party in the Harmony Village Apartments. The victim, who also lived in Harmony Village, said he had walked home from the party and woke up to find Chavez on top of her.

A second defendant, Isreal Martinez Ruiz, was acquitted of criminal attempt to rape, but was found guilty of criminal trespass.

He was sentenced to 12 months. It was also brought out in court that Ruiz was also in the country illegally.

The victim identified Ruiz as the man she saw sitting in the bedroom that August 31 morning. But she told the jury that Ruiz never touched her.

The victim told jurors that when she woke up and screamed, Ruiz told her "it's OK, we gave your friend money."

The victim told jurors the rape took place after she blacked out from being intoxicated at a nearby party.

A Peachtree City Police officer told the jury that when she arrived at the apartment Chavez told her he had paid $50 to have sex with the victim. She said he also told her that the girl's boyfriend had used a knife to let them in the victim's bedroom.

She also testified that Ruiz later admitted to paying $30, but "did not participate because she woke up screaming and they took off."
Ruiz also told her, the officer said, that the boyfriend had used a fork to get into the victim's bedroom.

In a separate case, Joseph Fitzgerald Carroll was sentenced to 10 years, one to serve, by Superior Court Judge Paschal English after pleading guilty to criminal attempt child molestation, criminal attempt enticing a child for indecent purposes, and computer pornography and child exploitation.

Special conditions prohibit Carroll from using a computer and have no contact with children under the age of 16. He must also undergo a psychosexual evaluation and register as a sex offender.

"It troubles me that someone with your background allowed yourself to get involved in this," said English.

Carroll was arrested by Peachtree City Police in 2007.

Also Ryan Presley was sentenced to 15 years, six to serve, by Judge Caldwell after pleading guilty to child molestation.

He had initially been charged with aggravated child molestation, officials said.
