(July 23, 2007) — BATAVIA — If it weren't for bad luck, he'd have no luck at all.
A suspected illegal immigrant is due in court Wednesday after a hit-and-run involving an off-duty immigration officer.
An off-duty Batavia city police officer saw a vehicle run a red light at Main and Oak streets at 12:09 a.m. Friday, hit the immigration officer's vehicle, then head north on Oak Street, according to the Batavia Police Department. The police officer followed until backup arrived.
Gerardo Morales-Diaz, 18, of 7891 Oak Orchard Road, Batavia, and his passenger suffered minor injuries, police said. The immigration officer was not injured.
Morales-Diaz was charged with drunken driving, unlicensed driving, leaving the scene of a personal injury accident and passing a red light, police said. He and his passenger were found to be in the United States illegally and were turned over to the U.S. Border Patrol.
Morales-Diaz is due in court at 9 a.m. Wednesday

Why did they even let him out? They could have kept him until Wednesday/

If they were turned over to the U S Border Patrol don't they keep them incarcerated until they go before a judge ?
