Napolitano weakens illegal immigration rule enforcement

In a press release on July 10th, 2009, Homeland Security Secretary Janet Napolitano announced that the U.S. Immigration and Customs Enforcement (ICE) has standardized the Memorandum of Agreement (MOA) used to enter into ‘287(g)’ partnerships. Section 287(g) was originally added to the Illegal Immigration Reform and Immigrant Responsibility Act (IIRAIRA) of 1996, ostensibly to empower local law enforcement jurisdictions to aid in the apprehension of illegal aliens.

However, Napolitano’s new MOA indicates that in fact, she believes the 287(g) has not been employed in the spirit of its original intent in certain jurisdictions. She goes on to explain, “This new agreement supports local efforts to protect public safety by giving law enforcement the tools to identify and remove dangerous criminal aliens.â€

What do we the people do when our own Gov picks and chooses what laws they want to enforce? And even take it a step further by having appointed people tell those that are intrusted with upholding the law , to simply look the other way when a crime is being committed. These officials are committing treason and should be delt with as such. Otherwise we are now a Bannana Republic, with no laws that matter.

I honestly believe they have been for quite sometime NM! How can our own governmet completely ignore the rule of law! What's happening to this country? This woman is a danger to the health and welfare of all Americans and should at the least, be removed from her position of so called "leadership!"

I don't think what Janet is doing is legal and I hope Judicial Watch or someone calls her on this.She is advocating breaking our immigration laws which I hope gets her fired.

There are a lot of federal laws, besides immigration, that are routinely being violated. Most of the young men are not registered with Selective Service--a federal felony. There is unlicensed and under-the-table work, violating atate statutes and federal tax laws. But these usually require a higher level, than local, of law enforcement and are, unfortunately, rather weakly adhered to. I think this measure is designed to prevent any arrests without a reasonable cause.

It does tie the hands of local law enforcement but may also protect those agencies from lawsuits by ACLU, etc. for false arrests.
