Rock County man arrested for criminal sexual conduct

LUVERNE — A first-degree criminal sexual conduct charge was filed Wednesday against a Rock County man who denied the allegation that he had sex with a girl younger than the age of 13 but admitted to authorities that he is an illegal immigrant.

Francisco Rubi Depaz, 21, of Luverne, could face up to 30 years in prison if convicted of the criminal sexual conduct charge, and U.S. Immigration and Customs Enforcement (ICE) has been informed of his whereabouts and status.

The complaint states authorities were contacted Monday by the parent of a child who claimed Depaz, a family acquaintance, had sexually assaulted her while he was living at the house for a few months.

During a forensic interview, the girl claimed Depaz had sex with her on many occasions and that she believed they were boyfriend and girlfriend. She indicated he always wore condoms during sex. She also claimed she had performed oral sex on him several times.

During an interview on Tuesday, with the assistance of a language line, Depaz denied any sexual contact with the girl, but said she had “come on to himâ€
