    U.S. District Judge J. Thomas Marten ruled today against three Hispanic families who had claimed a Catholic school policy discriminated against their children. Marten said this afternoon the Catholic Diocese of Wichita’s policy requiring students to speak only English while at school did not rise to the level of a "hostile educational environment."The lawsuit sought an end to the English-only policy, which Marten denied.

    THis lawsuit had its origins because of some serious disciplinary issues with unrluly Hispanic students who made comments etc. directed at teachers, staff etc. in Spanish and did so on a regular basis....the Spanish-speaking students were the ones causing a "hostile environment" ....the school took action by establishing an English only rule...as they have every right to do so in a private school. The "Hispanic families" cried racism....and I believe, MALDEF may have been involved in the lawsuit....in Janet Murguia's home state, no less (boy, she must be fuming!).

    Great ruling for common sense . Also to bad this judge doesn't sit in the Federal 5th District on the Appeals Court .

    Wichita — A Catholic school’s policy that requires students to speak only English while in school does not in itself create a hostile learning environment, a federal judge ruled Friday.

    U.S. District Judge J. Thomas Marten ruled for the Catholic Diocese of Wichita, denying a request by three Hispanic families to ban the policy. While the policy as written did not violate any law, the school’s failure to recognize its impact on the Hispanic students was troubling, he said.

    ut the judge was critical of the administration for imposing the rule without any discussion with the Hispanic community.


    SChool rules are school rules...."Hispanic" families don't need to be consulted about any of it.....all parents should be notified of any school policy changes regardless of their "ethnicity". No, these arrogant families would have made a stink even if they had been previously "consulted". The bottom line is their kids were disruptive brats who continued to cause trouble at the Catholic school....and the "families" didn't like the fact that the school addressed the issues in such a manner. Too bad...play by the rules or go to public school.

    Didn't seem like the Asian community has a problem with this policy. Again, it's just arrogant hispanic speakers whining. They have no shame? Makes me ashamed that people of MY heritage must be so viperous and arrogant that they demand an entire nation cater and conform to them!

    Good for the judge, he made the right call!
