    Judge: Carcieri can enforce immigration order

    PROVIDENCE -- A state judge on Monday permitted Rhode Island Gov. Don Carcieri to force private employers who do business with the state to electronically check their workers' immigration status.

    But Superior Court Judge Mark Pfeiffer ruled that Carcieri cannot end existing contracts until the state takes public comment on the new rules and issues guidelines for enforcing them.

    Carcieri's order, signed in March, requires that the companies use a federal database called E-Verify to vet new hires. The state branch of the American Civil Liberties Union had sued to stop Carcieri from applying his order to private firms.

    Carcieri's order also forces state police and prison officials to identify illegal immigrants for possible deportation.

    Excellent........just as 43 states have passed laws to address illegal immigration woes....and more and more communities are using 287(g) successfully, more and more states, county governments and private employers will start using E-Verify. Currently, over 69,000 employers are using E-Verify, the Fed's are required to do so as of June of 2008...

    We are winning....This is good news all around, this allows employers to not have to worry about hiring illegals in the first place. I'm loving it.

    Right now congress wants to attach over 500,000 permanent green cards to the E-verify re-authorization bill. Please see the NumbersUSA alert and call your Senators and let them know we need E-verify with NO strings attached.

    "We are pleased with the Judge's decision to deny the temporary restraining order, which allows the Administration to move forward in requiring vendors to use E-Verify," said Governor Donald L. Carcieri. "More importantly, the decision clearly recognizes that my Executive Order was within my authority and allowed by the state's Constitution."

    Carcieri's order, signed in March, requires that the companies use a federal database called E-Verify to vet new hires. The state branch of the American Civil Liberties Union had sued to stop Carcieri from applying his order to private firms.

    "Although our request for a restraining order was formally denied, we are pleased that the judge in essence granted us one," said Steven Brown, executive director of the Rhode Island ACLU. "By acknowledging that the state clearly violated the Administrative Procedures Act in implementing the program, and by preventing the state from taking any action for the foreseeable future against vendors who do not register with it, the court has temporarily halted state enforcement of this flawed program, as we had requested.

    Carcieri's order also forces state police and prison officials to identify illegal immigrants for possible deportation.

    "We are pleased with the Judge's decision to deny the temporary restraining order, which allows the Administration to move forward in requiring vendors to use E-Verify," said Governor Donald L. Carcieri. "More importantly, the decision clearly recognizes that my Executive Order was within my authority and allowed by the state's Constitution."

    In the decision Judge Pfeiffer states, "The Executive Order does not violate the Separation of Powers Doctrine," and "does not encroach upon the power of the General Assembly to enact laws regarding state contracts." Further, the decision recognizes that "the Executive Order is not outside of the authority of the Governor to issue," and that, "the chief executive power of this state is vested in the Governor."

    The decision went on to state, "Nothing under the procurement statute or elsewhere in the general laws impedes the Chief Purchasing Officer, at the Governor's directive, from designing a procurement system that insures that vendors doing business with the State directly verify the employment of individuals who are legally entitled to work within Rhode Island."

    In accordance with the decision by Judge Pfeiffer, the Department of Administration will immediately move forward to promulgate a purchasing regulation that expressly requires vendors who are doing business with the State of Rhode Island to use E-Verify.
