    Feds defer deportation for Tucson man (updated)

    For the second time in two months, an illegal immigrant living in Tucson who was scheduled for deportation has been granted a federal deferral.

    Alfonso Morales-Macias learned Wednesday that he won’t be deported to Mexico on Friday as scheduled, said Phoenix attorney Mel Rodis, who led a campaign to hel Morales.

    Rodis and supporters called, e-mailed and faxed the Department of Homeland Security asking for a reprieve. Immigration and Customs Enforcement spokesman Vincent Picard confirmed the one-year deferral.

    Morales, 40, and his wife came to Tucson 20 years ago from Nayarit, Mexico, with tourist visas and overstayed, Morales said. Their two kids were born in Tucson, becoming U.S. citizens.

    Their daughter, Ana Morales, 18, is a senior at Sunnyside High School and plans to study to be a veterinarian at the University of Arizona. Their son, Alfonso Jr. Morales, 11, is in the sixth grade at at Sierra Middle School where he is a student body treasurer and is in the gifted and talented classes.

    In September 2007, Morales was arrested by immigration agents while working at a Tucson Target, Rodis said. He wasn't a Target employee, but rather an employee of a contracted janitorial service. After being held in detention, he posted immigration bond that allowed him to stay with his family while he and his attorney challenged his deportation.

    He was set to be deported Friday. He doesn’t have any criminal record other than overstaying his visa, Rodis said.

    this is outragous ! As far as illegal immgrants go , visa over stayers are WORSE than border jumpers because he and his wife known full WELL when they were suppose to leave ... i think they affirmed as much when they got the visa !

    Not only should he be immdeately deported but his wife should be going with him as well !! pronto ... their 18 year old daughter can care for the other kids ...

    I'd like to see a law established and then enforced that would mandate investigation into any and all public benefits such people collected while here illegally. Even if it's deemed the "Anchor Baby Citizen" was entitled to the benefits the public has the right to be informed.

    In a display of community unity and support, over 1500 calls and faxes were made to DHS Sec. Janet Napolitano, pleading for a grant of deferred action in the deportation proceeding against Alfonso Morales. Today, we received the great news that it was granted!

    "This is a clear demonstration of the power we have as a community when we stand together with our brothers and sisters in their demand for justice," stated Kat Rodriguez of Derechos Humanos.

    "Mr. Morales and his family are so thankful to all those that called so that his family can remain intact," stated Margo Cowan, one of his attorneys, "as they are an asset to our community and our country."

    A celebration will be held at Southside Presbyterian Church tomorrow, September 23, 2010, at noon to celebrate and give thanks to our great community.

    "We are fighting for justice, one family at a time, until we can come together as a nation to realize that we are one family." stated Rodriguez.

    For the past three years I have been fighting my deportation but now I am at the end of that fight and I am being told I must leave the United States by September 27. I cannot think about being separated from my wife and children.

    I have worked hard for the last 20 years to be a good husband and father to my children. I am scared that my children will not have a father to love them and walk with them through life's celebrations and challenges.

    Tucson, Arizona is our home. This is where my wife is and the only home my children have ever known. I don't want to be separated from them. I want to continue living my life in this country and I want to contribute back. I am not a criminal. I am a husband, a father, a hard worker. I am a human being.

    Please act to stop my deportation now so that I can have a chance at a life alongside my wife and children. I only have a few days before I'm deported. This is what I need most urgently from you. Please:
    1.Sign the petition and fax a letter to DHS to ask them to allow me to stay.
    2.Call Janet Napolitano, Director of DHS, at (202) 282-8495 and leave a message in support of me. This is an answering machine that fills up by the end of the day, so please fill it up with support for me.
    3.Call John Morton, Director of ICE, at (202) 732-3000 and leave a message urging him to take action and defer my deportation. This is a live comment line that will be picked up by a real human being so please be very polite.
