Illegal Immigrant Facing DUI In Fatal Del. Crash

NEWARK, Del. (CBS 3) ―Family and friends remembered a Delaware man whose life was cut short by a driver who should not have been on the road or even the country.

The suspect, 25-year-old Juan Quintero, was undocumented and under the influence, police say. Quintero has been charged with DUI, vehicular homicide and other related offenses in the death of Zachary Yates.

On May 21, Yates was driving southbound along Route 72 in Bear, Delaware. Driving in the other direction was Quintero, an illegal immigrant from Mexico who police say was intoxicated.

Investigators say Quintero swerved into oncoming traffic and hit the back of a passing school bus that was filled with children. Quintero's vehicle then flipped and eventually landed on top of Yates' vehicle, which was behind the school bus.

Yates was rushed to the hospital, but later succumbed to his injuries.

Quintero didn't have a license or even permission to use the vehicle, which was owned by someone else.

If Quintero is convicted and serves prison time, he will most likely be deported. Friends of Yates are fearful that if Quintero makes bail, with no documents, he could easily disappear.

"It's just going to be a shame if we don't get justice here," Yates' friend Jennifer Husler said.

"America needs to know who's here and who's not. We need to keep track of that. How are these people getting in?" friend Sam Goodwin said.

Yates was laid to rest on Wednesday.

"The world is a little darker place today," Yates' friend Tom Wilson said.

Quintero is being held on $100,000 bail and has a court appearance scheduled for June 1.
