    Osvaldo Aldrete Davila, the drug smuggler who was shot in the buttocks by El Paso Border Patrol agents Ignacio Ramos and Jose Alonso Compean in 2005, was arrested on drug charges at the Zaragoza Bridge this morning, officials with the U.S. Attorney's office said.

    Aldrete was arrested by agents of the Drug Enforcement Administration and the Department of Homeland Security Office of Inspector General on a sealed indictment charging him with conspiracy to possess with intent to distribute marijuana, and with possession with intent to distribute marijuana in September and October 2005.

    These alleged drug-related incidents occurred after Aldrete was shot in February 2005 near Fabens and after he was given immunity to testify against Ramos

    U.S. Attorney Johnny Sutton had been criticized for not going after Aldrete earlier.

    Today, Sutton said he was "pleased" to announce the arrest.

    "Just as Aldrete's alleged illegal conduct did not excuse the crimes committed by Compean and Ramos, likewise, their crimes will not excuse his. Compean and Ramos had their day in court and received justice in accordance with well established laws. Now, Aldrete will have his day in court and my office will work tirelessly to ensure that justice is done," he said in a written statement.

    Aldrete was given immunity for his testimony against Ramos and Compean who were convicted of violating his civil rights when they shot him as he was running back to Mexico near Fabens in

    February 2005. The immunity agreement only covered that incident. Ramos and Compean are serving decade-long sentences in prison.

    Ramos' father-in-law Joe Loya said he never had any doubt that Aldrete would one day be arrested.

    "Once a drug smuggler or a drug dealer, always a drug smuggler. It was just a matter of time," he said.

    Aldrete's first court appearance will be tomorrow.

    EL PASO (AP) — A Mexican man shot by a pair of U.S. Border Patrol agents who were later convicted in the shooting has been indicted on federal drug smuggling charges, authorities said Thursday.
    Osvaldo Aldrete Davila was arrested Thursday at an international port of entry in El Paso, according to U.S. Attorney Johnny Sutton.

    A sealed indictment was issued in October charging him with smuggling marijuana in September and October of 2005, several months after he was shot in the buttocks while fleeing from a pair of Border Patrol agents.

    The agents, Jose Alonso Compean and Ignacio Ramos, were convicted last year of shooting Aldrete and lying about it.

    Aldrete is scheduled to appear in federal court in El Paso on Friday.

    Sutton noted that critics of the prosecution of the agents have complained that Aldrete, "the fleeing, unarmed drug smuggler they shot," should have been prosecuted.

    "I have repeatedly said that if we obtained sufficient competent and admissible evidence against Aldrete, we would prosecute him," Sutton said in a statement.

    Too bad they didn't have the guts or moral fiber to give the good guys immunity. What's the point of this travesty?? This looks to me like it justifies what the agents did....it proves he is and was a smuggler.

    I do think this may go a long way in bringing justice for the agents and a release from prison. There's no doubt they will win a new trial, but how long will they have to sit in that hellhole before that happens??

    That's what I'm thinking. Hopefully they'll be released in time to spend the holidays with their families.

    Justice should have been dealt when he was shot in the errrrrr.....buttocks. Granting him immunity in 2005 was idiotic.

    Compean and Ramos were defending the U.S. against an illegal, drug smuggler and it's a travesty they are behind bars for doing their jobs.

    FINALLY some justice......Is Sutton sure that he doesn't want to put these DEA guys behind bars? I mean, they may have put the hand-cuffs on too tight or something. Let's hope they gave this repeated drug running offender the red carpet treatment

    I say they give Ramos and Compean a pardon in exchange for their testimony of this guy's criminal past, resisting arrest, etc. Geez, if Sutton would have prosecuted the right guy to begin with, his cartel dealing days would have been over and further crime averted.

    Osvaldo Aldrete-Davila, the drug smuggler who testified for the prosecution during the trials for Border Patrol Agents Ignacio Ramos and Jose Compean, has been arrested on charges of bringing more than 750 pounds of marijuana into the United States.

    Aldrete-Davila was arrested today at the El Paso border crossing on charges involving what has become know as the "second load," in which he smuggled a second 750-pound load of marijuana into the U.S. after he was given immunity by the prosecutor, U.S. Attorney Johnny Sutton, for the first load.

    As WND reported, Cipriano Ortiz-Hernando, the stash house operator in the "second load" brought across the border by Aldrete-Davila, pleaded guilty in El Paso in August to federal drug charges.

    WND also reported on a Nov. 21, 2005, memo by DHS Special Agent Christopher Sanchez indicating DEA investigators conducted a "knock and talk" with Ortiz-Hernandez in Clinton, Texas, Oct. 23, 2005, in which they learned of Aldrete-Davila's second operation.

    According to the report, Ortiz-Hernandez positively identified Aldrete-Davila as the driver who dropped off 752.8 pounds of marijuana in a 1990 Chevy Astro van at Ortiz-Hernandez's home.

    Ortiz-Hernandez said he was able to make the identification because Aldrete-Davila lifted his shirt to show him the catheter inserted by a U.S. Army doctor at Beaumont Medical Center in El Paso. Aldrete-Davila was treated at government expense for the gunshot wound he suffered in the initial Feb. 17, 2005, encounter with Ramos and Compean, who shot at him as he abandoned a vehicle loaded with drugs and fled on foot back into Mexico.

    Ortiz-Hernandez – reportedly in a wheelchair at the time of the DEA interview – reciprocated by showing Aldrete-Davila his own catheter.

    According to Sanchez's report, Aldrete-Davila took 752.8 pounds of marijuana across the border on Oct. 22, 2005.

    WND also reported prosecutor Debra Kanof argued at the Ramos-Compean trial that presiding U.S. District Judge Kathleen Cardone should seal any discussion of Aldrete-Davila's involvement in the second load involving Ortiz-Hernandez.

    Cardone ruled not only that defense attorneys were prohibited from revealing any information about Aldrete-Davila's second load to the jury, but defense attorneys and even the families of Ramos and Compean would be prosecuted for violating the judicial seal should they reveal to the press any hint of Aldrete-Davila's continuing drug career.

    Aldrete-Davila's arrest is certain to renew pressure to release Ramos and Compean, who currently are in solitary confinement in federal prison, serving prison terms of 11 and 12 years, respectively.

    President Bush so far has refused to intervene in the case of Ramos and Compean, whose appeals still are pending.

    In view of Aldrete-Davila's arrest for the second drug load brought into the United States while he had immunity from Sutton's office and was in possession of a Department of Homeland Security border pass card, Sutton's decision to withhold from the jury information about the second load may not be politically sustainable.

    Attorneys for Ramos and Compean are expected to press for a complete release of all files concerning Aldrete-Davila that Sutton and various federal agencies have so far withheld from the jury and the public regarding the self-admitted drug smuggler.
