Will Senate Bill 1070 be squashed?

The big question in Arizona today: will she or won’t she?

Will U.S. District Court Judge Susan Bolton block Senate Bill 1070 from taking effect next week until she can hear arguments on the issues in contention? Or will she let it go into effect as scheduled on July 29?

As I understand the purpose of a preliminary injuction, it’s to prevent the harm that would take place should the law go into effect. You don’t get an injunction just because you fear something will happen. You have to be able to prove it, along with demonstrating that you will likely prevail on the merits of the case.

The feds, in asking that the law be blocked from going into effect, say S.B. 1070 is already causing “irreparable harm to the United States and this harm will only be magnified if the law goes into effect.â€
