The reportage by the Deseret News is sloppy sraight down the line. At first this guy sounds like a good example for mercy but the more you read it the more screwed up it gets. There have always been laws against working in the United States without the papers. The laws have been much harder since 1986. This guy was working for the city of Ogden under false papers and now he wants to get consideration from the US.
Then he does not help himself where he is. He has six vehicles and he is not doing business. He has not helped his own family in Cuauhtemoc except to bring them in as other illegals. With the amount he was making he should have started a farm and another business he would be working for in Cuauhtemoc instead of wasting time in the park.I support enforcement and see its lack as bad for the 3rd World as well. You're a bit too judgmental with little facts
I am the attorney for Mr. Fernandez, whose case recently has been accepted at the US Supreme Court. Your characterization of Dennis Romboy's story (the reporter has won several awards and accolades, and thank goodness writes English much better than you do) as sloppy is outlandish.
Where did you see that Fernandez worked for Ogden City with false papers? He never did.
Where did you come up with the story that he brought his family from Cuathemoc illegally?
He never did.
Looks like you attack a neutral story instead of arguing the merits of the case.
Fernandez applied to become legal, and qualified under the law. He was given a work permit. Then the government enforced a never-before enforced 96 law reinstating a deportation that occurred nearly 25 years ago.
If Fernandez had applied in the 9th Circuit he would have his green card right now.

Deseret Morning News graphic Keen argued before the 10th Circuit Court of Appeals � Fernandez-Vargas' only recourse � that immigration authorities should have ruled on his permanent residency application before imposing the old deportation order. Furthermore, he said that the reinstatement law was applied retroactively because Fernan- dez-Vargas returned long before it took effect in 1997.
The appeals court disagreed, concluding the deportation order could be reinstated because Fernandez-Vargas' marriage and application for permanent residency did not occur until 2001. The reinstatement then rendered him ineligible for a status adjustment.
If this story is true then its a typical tragedy caused by not the rule of law but stupidly the of law.
There is a trial going on right now in California for this,
Officer Tony Zeppetella, 27, of the Oceanside Police Department, was murdered on June 13, 2003. Officer Zeppetella stopped Adrien George Camacho for a traffic violation. Camacho pulled out a gun and shot Zeppetella. Camacho then pistol-whipped the injured officer before shooting him again, and killing him with the officer's own gun. Camacho is an illegal alien from Mexico and a gang member with a criminal history that includes five previous felony convictions. He has been deported several times.
Please tell me what a 5 time convicted felon was doing out of prison, the system told this ALLEGED murderer that the law doesn't mean anything especially the immigration laws.
Of course that just my opinion I could by wrong. I'm not prejudiced some of my best friends are lawyers. No small animals were harmed or appliances damaged in the course of writing this rant.
