    CALIFORNIA : Election Voter Complaint


    The Secretary of State's Election Fraud Investigation Unit primarily investigates election related criminal violations, as provided by the California Elections Code.

    Look, folks, Diaz broke the law. Then, she secured a false California driver’s license and a false Social Security card. Had you or I used that phony card as she did, we’d have landed in federal prison.

    Now since Nicky Diaz is getting involved in politics and may sway the California Elections, the question is , "Has She Voted?"

    If an illegal invader like Diaz has the cohunes to walk into a state office and present fraudulent documents in order to get a CA drivers’ license; what would make anyone believe this criminal would suddenly get a conscious and become law abiding when it comes to casting a vote in the seclusion of her own home or in the privacy of a voting booth!

    They’re ALL doing it and our politicians know they’re doing it! Why else would they pander to these criminals, with promises of supporting amnesty and speaking out against laws like SB1070 if they were not getting something in return for their efforts!

    Nicky Diaz--identity thief or guiltless illegal immigrant?

    October 12th, 2010 7:00 am ET.

    "Bogus" or "fake" have been used by the media to describe the Social Security number used by Nicandra Diaz Santillan. Santillan, known as Nicky Diaz, is the former housekeeper of California Gubernatorial Candidate Meg Whitman. Few reporters and commentators link Diaz to identity theft, a felonious crime punishable under state and federal laws. The nationally publicized Diaz debacle illustrates the failure of the media to connect the dots between identity theft, illegal immigration and related crimes.

    Our research suggests that the Social Security number used by Diaz is not bogus. The number was issued in California in 1978, and it is associated with another woman that lives in Southern California, who is either a victim of identity theft or a co-conspirator in identity fraud.

    Did Diaz or a third party steal the Southern California woman's Social Security number from which Diaz's Social Security card was forged? Or did the woman willingly share her Social Security number with Diaz aiding and abetting in identity fraud? Either way, misuse of another person's Social Security number to obtain employment is an identity theft offense under both federal and state laws.

    In addition to the crimes associated with the illegal immigrant status of Diaz, which could result in her deportation, Diaz could be charged with identity theft and criminal possession of a forged instrument, if not forgery. Additional criminal charges could stem from how she used the illegally obtained Social Security number, the forged Social Security card and the illegally obtained driver's license.

    For example, in addition to obtaining employment illegally, did Diaz use the forged Social Security card to obtain her California driver's license, or is the driver's license a forgery too. Were the falsified identifications used to facilitate financial transactions such as opening a bank account and obtaining credit cards or loans? Did she misrepresent her identity with the illegal identifications to obtain insurance, medical services, housing, utilities, government benefits or other services? If she used the U.S. Postal Service, the Internet or bank wires for any of the transactions, she could also face other federal charges.

    Dozens of state and federal charges including identification fraud, credit card fraud, computer fraud, mail fraud, wire fraud, financial institution fraud and immigration document fraud could be filed against Diaz as well as most every illegal immigrant that is caught using so-called fake or bogus identification.

    Let's not forget the social impact of identity theft on the victims. Victims, whose Social Security numbers are misused, often face financial challenges and other hardships. Identity theft victims often suffer from emotional distress stemming from the invasion of privacy and havoc of having their name, Social Security number or both misused. Victims can spend hundreds of hours of time over a period of years trying to restore their name and financial identity.

    Most illegal immigrants working in the United States are using falsified identification documents that are based on the theft of innocent people's identities. One crime leads to another. Illegal immigrants are often guilty of a multitude of felony crimes related to identity theft and the use of false documents. They commit identity fraud when they go about normal daily activities such as banking, driving, and going to the doctor's office while using falsified identification.

    For this reason, comprehensive immigration reform is necessary. Reform must address avoiding the pitfalls of using identity theft to facilitate immigration.

    It is a felony in California to use the personal identifying information of another person without the authorization of that person for any unlawful purpose including to obtain credit, goods, services, or medical information (Penal Code section 530.5 et. seq.).
