    Unsurprisingly, Boehner threw down the gauntlet in advance of Obama’s pretty unconstitutional suggestion he can legislate from the executive branch so folks can “keep their plans”:
    “The White House says it’s looking for some administrative ‘fix’. Of course, no one can identify anything the president could do administratively to keep his pledge that is both legal and effective. Promise after promise from this administration has turned out not to be true. So when it comes to this healthcare law, the White House doesn’t have much credibility. Let’s be clear: the only way to fully protect the American people is to scrap this law once and for all. You can’t fix this government-run healthcare plan called Obamacare. This is going to destroy the best healthcare delivery system in the world….”

    Now’s time for the surprise face. On MSNBC’s “Now with Alex Wagner,” former Democratic National Committee Chair Howard Dean broke with the party line in his commentary on the President’s proposed Obamacare fix. Via The Weekly Standard:
    “I wonder if he has the legal authority to do this, since this was a congressional bill that set this up,” said Dean of Obama’s proposed fix.

    That’s a delicate way of putting it out there: probably not legal. Maybe this isn’tsuch a new phenomena after all. The former Vermont governor said this about Boehner in 2011:
    “I think John Boehner’s a reasonable person. I certainly don’t agree with his political thought philosophy, but I think he’s a good Speaker, and I think he understands how you get things done in Washington,”

    UPDATE: Dean and Boehner aren’t the only ones questioning if Obama can do this on his own.

    Insurance companies cancelled policies b/c they didn't meet law's requirements. So how does he suspend those requirements w/o changing law?

    Not sure he's actually changing anything - just encouraging state insurance commissioners & companies to do what they already can @brithume

    @JohnJHarwood So is he suspending penalties for non ACA-compliant policies? If so, where is the legal authority for that?
