I cannot believe what Glenn Beck seems to be up to, but it is scaring me! Glenn Beck is right on target with getting rid of the income tax. But what does he seem to choose to replace it? The alleged fair tax. And now Glenn Beck has Judge Napolitano on his TV show who correctly states we need to “starveâ€
Or better yet just demand they pass the FairTax and then under separate legislation repeal the 16th Amendment within the 7 years of the sunset provision of the FairTax?
I oppose a Constitutional Convention, unless it is solely for the purpose of repealing the 16th Amendment by the states because Congress refuses to do it.
But I'm glad to see Beck and Napolitano coming out in support of the FairTax. I hope more television commentators and others will do so in the future.

The private pension funds are a serious problem and just another reflection of the dire straits of our economy. We're in an economic collapse so everything everyone thought they had or would have by retirement is quickly evaporating. You can't flood our nation with millions of immigrants a year, ship our manufacturing job base out and end up with anything more than a totally bankrupt nation.

The FairTax repeals mandatory federal income taxes, all income taxes, on individuals, corporations and estates and replaces it with a national retail sales tax on new goods and services purchased for non-business purposes and exempts through a Rebate all consumption up to the family consumption allowance which for a family of 4 exempts the first $28,000 of potential spending on such items and services each year upfront automatically pro-rated every month for every US citizen or legal resident who signs up for it. It also abolishes the IRS 12 months after implementation of the FairTax, destroys all IRS records, and prohibits future funding for the IRS.
I've read some of the arguments over the years about the existing income tax not being legal, and I think there are some people who have refused to pay income taxes and may have even gotten away with it through the courts.
But that is an expensive and tedious way to go. We should just demand a repeal of all mandatory income taxes and replace them with a voluntary indirect FairTax, a national retail sales tax on consumption. I oppose the Flat Tax because that is still a mandatory income tax, just a single rate income tax with fewer deductions, but requires the same process of reporting to Nanny, filing a return, etc., etc., etc.
I prefer the FairTax over any other tax proposal I've seen discussed or proposed by anyone in the past 30 years I've been studying them.

I thought Glenn Beck's show today was great. I loved his question and answer session and was very proud of all the Americans who spoke up and out about their involvement in the Tea Parties and their reasons for participation.
Don't forget to fix the 14th Amendment concerning children of illegal parents in the United States?
But do we trust these elected officials of today to fix anything?
This is what the FairTax means to the average American earning a household income of $50,000 a year as an example:
A family of four that earns $50,000 in wages pays 7.65% in social security tax and approximately 15% in federal income tax. This amounts to $3,825 in social security savings and assuming adjusted gross income of $40,000 another $6,000 in federal income tax.
This family no longer pays the $3,825 in social security taxes or the $6,000 in federal income tax, so they take home $9,825 a year more in expendable income under the FairTax.
In addition, they will receive the Rebate if they want it in the amount of $6,440 per year. The combined new expendable income for this family of 4 is $9,825 + $6,440 or $16,265 a year. Add in the savings on filing tax returns of $175 a year and this family is now enriched by $16,440 a year by the FairTax. That’s over $16,000 more on an estimated previous take home of $40,000 (after tax) or a 40% increase in the typical family’s net expendable income.
That new expendable income is now safe in the pockets of the Americans who earned it under the FairTax system. Now they decide what they do wtih their money. Save, invest, spend, whatever they choose to do that is best for them. The essentials they need to live on are exempted through the Rebate and they can spend up to the family consumption allowance on new goods and services, or conserve, spend less, save, buy some used homes and cars, whatever they decide, they still receive the Rebate if they want it, and there is no reporting or accounting, because over the long haul, there's no reason for it. All they have to do is whatever they choose to do, and once a year update the Rebate form that verifies who is in still in their household and provide their social security numbers. The Rebate is handled by the Social Security Administration not the US Treasury Department.
The FairTax rate is divided into two components, 1 portion of 8.09% ear-marked for social security and medicare and 14.91% earmarked for General Revenue for a total rate of 23%.
Every one receives the same Social Security and MediCare benefits they receive under the present system but they are no longer funded by payroll taxes, they are funded by the FairTax national retail sales tax.
On the Rebate, you can receive a check if you want, or designate a direct deposit or apply it to a Smart Card, your choice.
The FairTax can mean the difference between a family having health insurance they pay for or not having it, because under the FairTax, they can afford to buy it.
The FairTax can mean the difference between people losing their homes and or not losing them, because under the FairTax they can afford to make their payments.
The FairTax can mean the difference between people being able to save for college for their kids, because under the FairTax they can afford to save.
The FairTax can mean the difference between people having their own retirement savings for their Golden Years in addition to a securely funded Social Security Program, because under the FairTax they can afford to invest in secure investments to fund their lifestyle when they retire.
The FairTax is not a constitutional issue, it is the difference between Americans being able to survive as independent free citizens of the United States, or not. There is no single piece of legislation more important to the American People and their present and future than the FairTax legislation, HB 25 in the US House of Representatives, and SB 296 in the US Senate, awaiting your calls, faxes, emails and letters to demand its passage immediately.

We really don't need to fix the 14th Amendment, we need to pass legislation that instructs the US government to abide it. No child born to foreign nationals who are citizens of other countries should be recognized as US citizens now under the 14th Amendment unless as under the 14th Amendment, their parents were held as slaves in our country under our jurisdiction.Quote:

Well, what the laws will do is fix the US government's interpretation of the 14th Amendment. There's already at least 1 legislation drafted and already introduced into Congress. (a) In General- Section 301(a) of the Immigration and Nationality Act (8 U.S.C. 1401(a)) is amended by inserting before the semicolon the following: `, of a mother who is a citizen or legal resident of the United States'.
(b) Effective Date- The amendment made by subsection (a) shall apply to persons born after the date of ratification of an article of amendment to the Constitution of the United States that repeals the first sentence of section 1 of the fourteenth article of amendment to the Constitution of the United States.

This Act may be cited as the ‘Birthright Citizenship Act of 2009’.
SEC. 2. CITIZENSHIP AT BIRTH FOR CERTAIN PERSONS BORN IN THE UNITED STATES.
(a) In General- Section 301 of the Immigration and Nationality Act (8 U.S.C. 1401) is amended--
(1) by inserting ‘(a) IN GENERAL- ’ before ‘The following’;
(2) by redesignating paragraphs (a) through (h) as paragraphs (1) through (8); and
(3) by adding at the end the following:
‘(b) Definition- Acknowledging the right of birthright citizenship established by section 1 of the 14th amendment to the Constitution, a person born in the United States shall be considered ‘subject to the jurisdiction’ of the United States for purposes of subsection (a)(1) if the person is born in the United States of parents, one of whom is--
‘(1) a citizen or national of the United States;
‘(2) an alien lawfully admitted for permanent residence in the United States whose residence is in the United States; or
‘(3) an alien performing active service in the armed forces (as defined in section 101 of title 10, United States Code).’.
(b) Applicability- The amendment made by subsection (a)(3) shall not be construed to affect the citizenship or nationality status of any person born before the date of the enactment of this Act.

This is the one I like, because you don't have to amend the 14th Amendment, it reflects the 14th Amendment and binds the government to do its job.
I like the bill number too, the year the 14th Amendment was passed, 1868. Now I can remember it.

What is the difference to you between excise taxes on consumption and a FairTax on consumption at the retail level? The FairTax taxes all consumption of new goods and services without prejudice, without discrimination, without manipulation of consumers to buy one article over another, to purchase one service versus another. The FairTax is a uniform, unbiased excise tax on consumption at the final point of distribution to the consumer at the retail level. It exempts essentials through the Rebate and is completely and fully uniform, is not a direct tax like income or property taxes, but is an indirect tax exactly like excise taxes, imposts and duties, and as a result do not need any involvement by the states except their voluntary agreement, to collect the tax from the retailers, monitor the program, send in the money and be paid a handsome fee for their collection services.
If you want to balance the budget, we need to pass a Constitutional Amendment along the lines of what most states have with their state constitutions, and except certain periods for war, disasters, etc.
Anyway, I like the FairTax very much, and believe it is the best tax collection measure possible, see no constitutional issue with it at all, would like to see the 16th Amendment repealed within the 7 year sunset provision of the FairTax legislation which I believe the states will ratify without dispute as it certainly favors their states to do so, and at some point when our economy has recovered, pass a Balanced Budget Amendment to protect our nation against this reckless debt spending in the future when we can afford to balance the budget and pay off this horrendous debt.
As to the constitutional convention, one isn't necessary to pass the FairTax. Americans need to learn more about the FairTax, how it works, how it benefits them, our economy and our nation, and then lobby Congress as hard as they can to demand passage of HB 25 in the US House of Representatives and SB 296 in the US Senate, immediately.
The FairTax eliminates the income tax, which means it eliminates any legal incentive or motivation for corporations to contribute to these endless numbers of not-for-profit 501 C 3 organizations like National Council of La Raza and MALDEF and all the other Globalist riff-raff hiding behind "charity" trying to open our borders and destroy our country.
The FairTax also taxes all consumers, including illegal aliens, so under the FairTax, they don't get a free ride on the taxpayers of the United States. They also don't qualify under the FairTax for the Rebate, because they aren't US citizens or Legal Residents, so we get taxes from them to pay for their costs of illegal immigration without having to Rebate any of it back to them for their essentials. There are those among us who will continue to try to convince the people, especially those who are participants in tea parties across the country, that they cant do anything to take back their country, that they are helpless. This is a lie and history proves it. Let us look at the history prohibition and the 18th Amendment and how it was repealed.
Please check HERE for how the 21st Amendment [ending prohibition] came to be. It was submitted to Congress by Sen. Blain of Wisconsin and then sent to the states by Congress for ratification with the stipulation that conventions in the states would have to approve the amendment as opposed to the various state legislatures, Congress having the choice of the method of ratification as per Article V!
In any event, Glenn Beck and Judge Napolitano ought to be encouraging every tea party member to start a campaign demanding their state’s delegation to Congress to introduce a resolution to send an amendment to the states for ratification that provides:

"What" you are proposing is repealing the 16th Amendment without legislation in place to fund the federal government.
"What" you are proposing with "miscellaneous excise taxes on various articles of consumption" is prejudicial and discriminatory as all present and past excise taxes have been and will always be and unless all consumption is taxed, there won't be enough revenue to fund the federal government, and unless it is all taxed at the same rate the same way, it won't be fair to any of the businesses or any of the consumers.
"What" you are proposing with regards to proportional direct taxation on the states, subjects the citizens of those states to the existing tax mechanisms allowed by all the states such as mandatory direct property taxes and income taxes and any new mandatory direct taxes their evil minds can conjure and certainly will conjure under your scheme, which just makes the residents of those states tax slaves to the states who are now by federal order tax slaves to the federal government.
So far, based on the comments by the members of this forum no one is interested in a Constitutional Convention. So I think that's a wrap on this one.
