On Monday’s “Special Report” on the Fox News Channel, Washington Post columnist Charles Krauthammer acknowledged that as the so-called March 31 ObamaCare enrollment deadline approached, the Affordable Care Act law itself is no longer the way it was originally envisioned when it was passed in 2010 given the actions of President Barack Obama. And that according to Krauthammer gives Republicans an opening to change the law should they take control of the Senate in the upcoming midterm elections.

“There are ways in which I think you can make changes, fundamental changes in the program, because Obama already made them himself. He’s abolished the individual mandate. It doesn't exist. It’s a fiction … He’s already changed it so much, that what we're dealing with is a facsimile of ObamaCare. There’s no individual mandate. Anybody who wants out simply has to say it's a hardship, check a box, it’s the honor system which means anybody who wants to be out is out. Anybody who wants an extension is going to get an extension – honor system, again, which a bureaucratic anonymous system means anybody can do anything, and there are no deadlines.”

“So it's a floating system. It’s exactly what Obama says. So if Republicans -- let's assume they win the Senate and do well, they can come together with a new plan where you have tort reform, for example, where you could purchase across state lines. You could keep some elements, perhaps, of ObamaCare. if Obama wants a veto, let Democrats defend that because they're still going to hate ObamaCare next year and the year after because rates are going to go up drastically, because all of these numbers, even if they are real, implies that the insurers are going to lose a boatload of money and they're going to have to hike up the premiums … And that’s why the administration is trying to punt everything into 2015 and 2016.”
