OSHA Moves Back Vax Or Test Deadline


OSHA’s initial vax-or-test deadline for the private sector was January 4th.
The deadline has been pushed back to February 9th.

From The Washington Times:
The Occupational Safety and Health Administration late Friday said it will extend the deadline for large businesses to comply with President Biden’s vaccinate-or-test rule after a federal appeals court reinstated it.
OSHA said it wanted to exercise “enforcement discretion” because the court battle suspended the rule for a time, causing uncertainty.
Agency officials said they will not cite a company for violating any part of the rule, or emergency temporary standard, until Jan. 10 and will not punish a company for failing to test unvaccinated workers until Feb. 9.
This comes after the 5th circuit court reinstated OSHA’s private employer mandate.

5th Circuit put OSHA private employer mandate on ice. 6th Circuit just dissolved the 5th Circuit order. Looks like this is headed straight to
#SCOTUS. Guess I know how I'll be spending Christmas "break"

Replying to @ShannonBreamSeveral asked how 6th outweighs 5th here. It's a unique situation in which 6th won a lottery to oversee all the pending challenges to the OSHA mandate. Trying to confirm there's an emergency petition already filed (or about to be) at SCOTUS for a temporary stay. Stay tuned!

Multiple emergency petitions are being electronically filed with #SCOTUS. Must assume both sides had them drafted in advance, simply waiting to plug in the particulars from the 6th Circuit's opinion. Thx to those who've sent me copies of their filings.
