    Illegal Immigrant In Fatal DUI Case Had 4 Priors
    (AP) ANTIOCH An illegal immigrant arrested in connection with a collision that killed a father of five was drunk and on drugs, and had four previous drunken driving convictions, law officers said.

    Jose Pena, 26, was allegedly traveling 90 miles per hour on March 31 when he crossed a double yellow line and hit 33-year-old Kent Boone. He also allegedly had two pounds of crystal methamphetamine in his truck, according to California Highway Patrol officers who later checked Pena's home and found more drugs.

    Pena was booked into the Solano County Jail on suspicion of murder, driving under the influence and drug offenses when he was released from the hospital a week after the crash, said Solano County sheriff's spokeswoman Paula Toynbee.

    Boone's family, including five children aged 12 to 5, was devastated by his death, and angry at Pena.

    "He needs to be in prison. There's no way they're going to be able to deport him and keep him out of our country," said Boone's widow, Regina Sorisio.

    The Solano County District Attorney's Office is further investigating the case.

    Federal immigration authorities also have placed a hold on Pena, meaning local law enforcement will notify Immigration and Customs Enforcement before releasing him, said spokeswoman Virginia Kice.

    Pena's bail was set at $950,000.

    An undocumented immigrant arrested in the traffic death of an Antioch father of five was impaired by drugs and alcohol, had four prior DUI convictions and may be charged with murder, according to the Highway Patrol and the Solano County Sheriff's Office.
    Jose Pena, 26, was booked into the Solano County Jail after he was released from John Muir Medical Center, a week after the March 31 death of Kent Boone, 33, in a head-on crash on Highway 12 in Solano County.

    Pena, who the CHP alleged had two pounds of crystal methamphetamine in the Ford Expedition he was driving, crossed a double-yellow line at an estimated 90 mph to pass another vehicle when he hit Boone's Ford F-350 pickup truck.

    Pena was impaired by alcohol and drugs when the crash occurred, had four prior drunken-driving convictions under an alias, and a narcotics conviction, the CHP said. Officers searched his Fairfield residence and confiscated more drugs and cash.

    Boone was en route to work as a pipe fitter, and his survivors were devastated. Neighbors on Rock Court in Antioch visit and cook daily for his children. Boone had two children from a previous marriage, 10-year-old twins Hope and Autumn, as did his widow Regina Sorisio -- Brannon, 12, and Mackenzie, 11. Together they had a 5-year-old son, Jacob.

    "I'm so thankful for our community," said Sorisio, 31.

    But his survivors also are angry about the other driver involved.

    "He needs to be in prison; there's no way they're going to be able to deport him and keep him out of our country," Sorisio said.

    "My reaction is, I can't believe this guy is not already in jail," said Sorisio's mother, Robin Sorisio. "Why wasn't he in jail before? Why do they continue to let these guys out, and they continue to make trouble for everyone? And of course, we cannot replace Kent."

    CHP officers have sent their report to the Solano County District Attorney's Office, which is conducting some follow-up investigation, according to CHP spokesman Marvin Williford.

    Pena is being held on suspicion of drug offenses, DUI and murder, said Solano County sheriff's spokeswoman Paula Toynbee.

    The federal Immigration and Customs Enforcement agency also has placed a hold on Pena, records show. The hold means Pena is potentially subject to deportation and ensures that local authorities notify ICE before releasing him, said spokeswoman Virginia Kice.

    The CHP also obtained a court order stipulating that bail be set at $950,000 and that drug proceeds not be used to post bail.

    There should be some way this young mother could sue local, state & federal officials for not deporting this illegal alien after his first DUI.

    Another family separated oh but they are citizens thats right they don't count. RELEASE HIM, thats a joke right!! To hell with immigration now its to late, he needs to spend life in prison with no chance of getting out and back into this country. This makes me so angry!!

    Next time you read or hear someone crying about babies being pulled off of the breast of an illegal during a raid...I want you to remember this story.
    Compassion for the children? Whose children? Their children? What about OUR children? What about Hope and Autumn whose dad will not be watching them graduate from high school and who will not walk them down the aisle? What about Brandon and Jacob whose dad won't make it to their little league games this year...or any year. What about Mackenzie, who will need her dads advice about boys soon and will have to do without it. Talk to me about having compassion for the children of those that make the choices...and I will tell you NO. I save my compassion for those that were given no choices.
    My heart aches. I think I shall sign off soon and go give my husband an extra hug tonight. And PRAY.

    Edited to add: I sent this info to Bill O'Reilly. Maybe he can beat Geraldo over the head with it for a while.

    What the f*** How many more Americans have to die before someone up there gets off their humps and does something?? I just found out the man who killed my grandson and brother was employed at PCL Construction in Orlando,FL. As are the 3 other illegals in the car with him that tragic night. I callled the HR department asking about their policies on hiring illegals and kept getting sent to an answering machine. All of us victims need to stand together and file a class action lawsuit against the government. And the companies that hire these illegals. Anyone interested can go to my profile and e-mail me. This madness has to stop. I am deeply sorry for that family. I know the pain and sorrow they feel and will have the rest of their lives.
    Do They understand the word ILLEGAL????

    I wonder if it would be a change in tactic for victims (like you Bren) to start filing lawsuits against the companies that HIRED the illegals. Don't they hold some responsibilties for the fact that their employment of these illegals keeps them here?

    Umm Proud, you might be on to something there, I don't see why a person couldn't, Employers are aiding and abetting, of course with out a secure and compentant way to check their legal status you would not be able to hold the employer responsible. They need a system that leaves no question that you checked the legal status of said person.
