    Eleazar Rangel-Ochoa shouldn't have been driving.

    Four-year-old Josie Bluhm shouldn't be dead.

    Those two facts are undeniable – and the tragic consequences of those facts were undeniably evident in a Douglas County courtroom Friday.

    A solemn Douglas County District Judge J Russell Derr sentenced Rangel-Ochoa to 32 months to six years years in prison – the maximum sentence for misdemeanor motor-vehicle homicide and for felony driving while he was suspended.

    Rangel-Ochoa, 27, ran a red light about 7:30 a.m. May 12 – crashing a truck into a van driven by Jayme Bluhm and carrying the Bluhms' three children.

    Josie's father, Kyle, and mother, Jayme, tearfully talked about their bubbly daughter. With her blonde-hair and a button nose, their middle child had an infectious personality.

    Jayme Bluhm had been headed to day care to drop off her children, then ages 5, 4 and 1. The collision ejected Josie, 4, and caused her death.

    Josie's then-5-year-old brother and best friend, Cayden, suffered six broken bones in the crash.

    Rangel-Ochoa, an illegal immigrant, had lost his license for 15 years after his third drunken-driving conviction in 2003.

    He wasn't drunk on May 12 – hence the misdemeanor motor-vehicle homicide charge.


    The case sparked concern about why Rangel-Ochoa hadn't been deported after his 2003 conviction. His previous attorney has said that immigration officials now are more stringent and that Rangel-Ochoa wouldn't be treated with such leniency today. He likely will face deportation after he serves his sentence.

    Yet so many today still believe that Drunk Driving should not be a deportable offense if no one is injured.

    murder is the intentional unlawful killing of a human being with malice aforethought.

    How can you prove he intentionally drover the car to smash into the family's van with intent to kill this young girl? You can't. It would be unfathomable. Let's leave the the filing of charges to the DA's. That's why they went to law school, passed the bar and spent years training.
    Our feelings are irrelevant. What is legal is what matters. It would be stupid to charge this individual with murder because he would never be convicted of murder. As a result it would be both illegal and unethical.

    atty, do the fact that he was driving with a suspended license, which im pretty damn sure he knew it was suspended doesnt change things?

    As much as I would prefer Reciprocities form of justice, attorneyatlaw is correct if we are to follow the law as we all belive we do. The trouble with trying to prove "intent" is there is nothing in this case that is tangible to intent. Intent is the hardest thing to prove in court. I know. The DAs Office told me with my ID Theft to prove intent and malice on the perpetraitor's part was almost impossible, and if we wanted to put him away, we had to ignore that part. This is why it was a manslaughter charge. If the DA's Office had tried to get Murder 1, the guy would have walked. And then the ballyhoo would have really resounded.

    Personally myself, I would rather see Dad take care of this, as I do believe in an eye for an eye, but that's not how the court sees it these days.

    I understand the point attorneyatlaw is making, but we now have advocate judges giving illegal aliens "get out of jail free cards". At this point in time we are not a nation of laws, we are practicing selective enforcement. Sanctuary Cities shield and protect them more than American Citzens. If 50 Americans were standing on a corner, the police would show in force with riot gear, but 50 illegal Aliens? Nobody says a word. Rule of Law ? Yes. Equal application? No. We are no longer a nation that practices Rule of Law.

    If Obama gets his way, this is just one of the millions of criminals who wont get deported. There are too many criminals within the illegal aliens for Homeland Security, ICE or any other agency to keep track of. Once they are found illegal, they need to be deported immediately BEFORE a crime is committed.
