Dear Ms. Morgan:

I am in receipt of your letter dated August 4, 2005 regarding the above named contract agreements.

Per our conversation, we are aware that the four Squad Bosses and one Crew Boss did not pass the PNW English Speaking Evaluation (Exhibit U). I informed you that it was the first fire that the crew was dispatched to and that the combination of excitement, pressure and nervousness played a big factor in the examination process. But, I also informed you that some of the Squad Bosses and Crew Bosses have passed inspection the years prior with the same inspector.

It is my belief that the inspection process that Oregon Department of Forestry currently has is not consistent year by year. I also believe that the inspectors range in their spectrum of rigidness and discretion. I would only suggest that adequate training and balanced training on how to perform a fair and neutral examination be required for all the inspectors in all districts. This would allow for a center lined inspection process, instead of having one inspector with a severe criteria and yet another inspector be so lenient.

Enclosed, I am providing copies of the individuals that did not pass inspection at the Rattlesnake Springs and Shitike Creek Incident. Also, enclosed are examinations of Cresencio Perez (CRWB) that passed on the next incident. We are trying to obtain a copy for Jose De Jesus Ornelas Dominguez (FFT-1) that was tested on the Wasson Incident in Medford, Oregon. I have placed a call to Medford ODF. I will forward a copy of the examination form once I obtain it.
