AG Barr rules that asylum seekers at the border who pass "credible fear" interviews and are transferred to a full deportation hearing are INELIGIBLE for release on bond.

Only DHS may decide to release them. Ruling is effective beginning in 90 days.

Credible Fear: A concept in US asylum law whereby a person who demonstrates that he or she has a credible fear of returning to his or her home country cannot be subject to deportation from the United States until the person's asylum case is processed.

Current US law allows those who pass Credible Fear Interview to be released into the country until their hearing date. Average processing time through the court system is 700 days.

New ruling means these immigrants would now be held until their hearing date, not released.
