    Stopping Anchor Babies from automatic U.S. Citizenship- How?

    How can this be achieved? Can no one pass a bill that stops this major driver for illegals to come to the US?

    Can someone who is better versed in the legalities and government help answer this? Can we not create a movement or a petition to start this?

    It is a really strong reason for an illegal to come here since even if they cannot get citizenship etc. their children get it automatically.

    Every Senate aid I've talked this over with(2) has told me that it will require a new constitutional ammendmant to accomplish this.

    I've heard many in the anti-illegal camp argue that the interpretation on the present ammendmant is the problem. In other words, there would need to be a new Supreme court ruling to get a new interpretation.

    Not being a lawyer, I dont know all the complexities of how that could be done. But the House DID try to add a legislative ammendment to HR4437, but it was struck down. I do think it will be tried again...and again. There are obviously SOME who think it could fly constitutionally or they would not even try to add it to legislation.

    I hope I have not confused you worse. That is my understanding of it. And I agree with you that we need to stop the anchor baby problem.

    What the law says is that any person born while their parents are under the jurisdiction of the United States is eligible for citizenship. The children born of diplomats are ineligible because their parents have an extra-territorial status. The children of illegal aliens have a questionable staus because their parents own actions have demonstrated that they regard themselves to be above instead of under American jurisdiction and laws. If they were under US jurisdiction they would have turned themselves into ICE.

    The anchor baby problem is a huge problem and it is so stupid and so unnecessary.

    Only traitors would have interpreted this to mean children of illegal aliens here in violation of the US Immigration Law subject to deportation and fugitives under the law.

    They've been working on this a long time haven't they?

    Here's where they get the idea...
    Amendment XIV Section. 1. All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
    This Amendment was passed in 1868 to give citizenship to freed slaves after the Civil War.
    In other words, there would need to be a new Supreme court ruling to get a new interpretation.
    DcSA is right on this. It will have to get in front of the Supreme Court to have the 'creative' interpretation clarified.
