    MEXICANS HAVE NO CONSTITUTIONAL RIGHTS

    On August 23, 2006, the Arizona Republic ran an article about an Los Angeles based immigrant rights group (Center for Human Rights and Constitutional Law) who filed a lawsuit against several Phoenix politicans.

    This organization alleges that the illegals "constitutional rights" were violated. Only citizens of the United States have constitutional rights, not illegals. Our Constitution was made for the citizens of the United States. The Constitution didn't intend for illegals to have any rights while they were living in our country ILLEGALLY. The Constitution in Mexico woudn't help American citizens get food stamps, QA or any kind of assistance. They would leave us in the street to starve and die.

    If we went to Mexico as illegals, we couldn't assert ourselves and say we have rights there. These illegal individuals want to force the American government and the American people to respect their illegal status. Mexico would deport us in a minute if the shoe was on the other foot. I think it is time that the U.S. government move forward and honor the immigrant laws already in place and take action.

    The article was entitled "Smuggling Prosecution Brings Suit" by Daniel Gonzalez.

    I think it's the part where it says something like God bestowed certain inalienable rights, life, liberty and the pursuit of happiness, that gives them the impression that they have "rights" whether they are a citizen or not.

    Seems funny to me when people choose to "use" God for their own gains then toss him out when there is no longer a need! I thought the secular progressives or liberals whatever you want to call them, who are encouraging these illegals, didn't think God had any place in our laws, and our government anymore! I wish someone could show me just where in our constitution it says that illegal aliens have the same rights as we do!

    I'm sure that there are probably some illegal loving traitors in DC working on putting that into our constitution

    We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty TO OURSELVES AND OUR POSTERITY, do ordain and establish this Constitution for the United States of America.

    Attorney General John Ashcroft wants the power to lock up immigrants suspected of terrorism and hold them indefinitely. Wouldn't this violate the Constitution?

    Not necessarily. True, the Bill of Rights applies to everyone, even illegal immigrants. So an immigrant, legal or illegal, prosecuted under the criminal code has the right to due process, a speedy and public trial, and other rights protected by the Fifth and Sixth Amendments. This fact sheet from the National Lawyers Guild outlines a host of rights afforded to immigrants and citizens alike. (There are a few rights reserved for citizens. Among them are the right to vote, the right to hold most federal jobs, and the right to run for political office.)

    But immigration proceedings are matters of administrative law, not criminal law. (As a result, the consequence of violating your immigration status is not jail but deportation.) And Congress has nearly full authority to regulate immigration without interference from the courts. Because immigration is considered a matter of national security and foreign policy, the Supreme Court has long held that immigration law is largely immune from judicial review. Congress can make rules for immigrants that would be unacceptable if applied to citizens.

    In 1952's Harisiades v. Shaughnessy, the Supreme Court upheld the right of Congress to expel noncitizens who were former Communists. "In recognizing this power and this responsibility of Congress, one does not in the remotest degree align oneself with fears unworthy of the American spirit or with hostility to the bracing air of the free spirit," Justice Felix Frankfurter wrote in his concurrence. "One merely recognizes that the place to resist unwise or cruel legislation touching aliens is the Congress, not this Court."

    Still, immigrants facing deportation do have some rights. Most are entitled to a hearing before an immigration judge, representation by a lawyer (but not one that's paid for by the government), and interpretation for non-English-speakers. The government must provide "clear and convincing" evidence to deport someone (a lower standard than "beyond a reasonable doubt").

    On the other hand, some immigrants who are suspected terrorists may not be allowed to confront the evidence against them. In 1996, Congress established the Alien Terrorist Removal Court, a secret tribunal that can examine classified evidence. (Interestingly, Congress mandated in the same law that an immigrant tried by the terrorist court would have the right to counsel at government expense.) But the Alien Terrorist Removal Court has never been used, and a Department of Justice spokesman said he isn't aware of any plans to use the terrorist court any time soon.

    Thanks, but I would never get elected. I'm not PC, I tell people the truth (even when they can't handle the truth), I would outlaw the ACLU, build the fence and imprison every business owner that hires illegals. So, my political contributions from corp, America or PACs would me $0.

    This should be titled "MEXICANS SHOULD NOT HAVE CONSTITUTIONAL RIGHTS." We've seen the Supreme Court acknowledge rights of a variety of individuals including illegal aliens, resident aliens and individuals with only minimum contacts. This has been going on for years.

    Crazybird that phrase just means that we are born with God given rights. It has nothing to do with aliens. The only Framer that saw this crap coming was Benjamin Franklin. Gore Vidal claims that Franklin said that Democracy would eventually break down because the character of the American people would coarsen. Looks like he was right.
