Judge says Laguna Beach can legally fund labor site
According to a judge's proposed ruling, there was insufficient evidence that the city's funding of the hiring site is illegal.

A lawsuit over Laguna Beach's day labor hiring site failed to provide enough evidence to show illegal action by the city, according to a judge's proposed ruling.
The ruling, a copy of which was obtained from the city's attorneys, came after Laguna Beach resident Eileen Garcia filed a lawsuit accusing the city of illegally funding the site, which was started in 1993 and is currently run by a nonprofit.
The lawsuit alleged that the city was not able to legally fund the site through community assistance grants because illegal immigrants were using the center to find jobs.
The ruling was issued Wednesday by Orange County Superior Court Judge Gregory Munoz.

Well, Orange County is one of the most conservative counties in the nation. We have a lot of patriots there that are fighting hard for our cause. Having said that, Laguna Beach is far and away the most liberal city in OC. Californians are not OBLs. We have fought and fought for immigration enforcement. We just have been over-ruled by the courts.

Orange County is conservative but Laguna Beach is second to San Francisco in liberalism. The judge's last name is Munoz...gee do you think he was biased?

Growing up in a multiculture and being friends with the old breed of Hispanics I am sad to say that I have recently came to the conclusion that I will never again vote for anyone with a Hispanic surname.

That's why I said it is far and away the most liberal city in OC. My point is that Californians as a whole have a lot of good values. San Francisco, Laguna Beach, and Hollywood do not represent California.

California and Texas both 'welcomed' illegals to work their fields ,factories ,landscapes and homes .

Their was a great white exudus from both states . They chose to run instead of fight . Just like all other states are doing now .

Florida did the same thing with the swimmers who took over Miami, then moved north to infect the rest of the state . Don't go to Miami unless you speak spanish . What was a beautiful American Paradise is now a third world ghetto crime infested cesspool .

I am so frustrated with complacent citizens who want others to do their fighting for them .

I'm an older woman and I stood my ground even when the bullets started flying , so i have no patiance with others who haven't .

Yes, its unfortunate that hispanic politicians are all in the pocket of La Raza, LULAC, MALDEF etc. They are doing a diservice to their community, because legal hispanics are the most negatively affected by illegal immigrants.

Yes, we have people from all over the nation here. Tons of people from New York, Chicago, all over the Mid-West, the South, you name it. Plus we have many, many military bases with soldiers and there families from all over the nation. We have cowboy communities that resemble the heartland. We have snow capped mountains, we have the city, we have the desert, we have the beach. California is a microcosim of the entire nation.

NOamNASTY I don't know of any Californians that "welcomed" illegals to California. Yes a lot of Californians have fled, but then alot of us have stayed to fight for our homes.

I am 61 years old and a native Californian. I have watched as my beautiful California has been destroyed, not only by illegals but also fellow Americans chasing the dollar! We have took in everyone only to be condemmed by people who don't really understand the dynamics of this state.

What has happened in California is now happening to the rest of the country. Instead of listeneing to the propaganda about California talk to Californians, get the real facts.

I am still proud to be a Californian!!

California and Florida are fast becoming third world cesspools. It's ashame that this is happening to our country.

My husband and I retired from the Silicon Valley and moved to the Central Valley to take care of my 93 year old mother-inlaw. I have watched this little town fight to retain it's American identity. Most of the old timers here came from OK during the dust bowl. They picked cotton worked the fields and worked on dairy's, they don't take kindly to being told that Mexicans do the jobs that Americans won't.

The conplaints I hear are from the people my age that have always worked in the cannery's being shut out by the Hispanic's. What I hear from the AG people is that the small family owned farms are being hurt by the Corporate AG. It's Corporate that wants to bring in illegals to do their work.

I think when America thinks of California they are getting Corporate California confused with the people of California.

I think it's time to just not pay taxes... really, this is absurd

California did fight!!! Several years ago the citizens passed by I believe 58% prop 187. That would have denied benefits etc. to illegals. A liberal judge threw it out, said it was unconstitutional. NOONE in any other state made noise. California was under siege and the rest of the country looked the other way. How do you fight a judge's rulings? You can't, just as what is happening today. Believe me what is going on in other states has been happening here for decades. Unfortunately we do have the loons in the Bay area and the major cities, but most Californians would end this crap in a nanosecond.

I have lived here in Southern California all my life and I don't know one person who likes the illegals here! I haven't a clue how all these nut case liberal kooks got elected. Illegals have ruined California and it looks like the government has plans in destroying the rest of the country...Now I know what Michael Savage means when he says the "Enemy Within." I think what we all can deduce from this is that we rarely listen to the clarion cry...we, the non Mexico border states, didn't listen when the border state U.S. citizens sounded the alarm over the past 20 years in terms of the massive incoming invasion of illegal immigrants. We, the rest of the nation, only listened when the negative effects of illegal immigration started affecting life in our own non border back yards-just like during WW II days when certain European countries turned a blind eye to the Nazi movement...they turned a blind eye thinking it wouldn't happen to them. When it did eventually come to their neck of the woods, they looked around for others to help them and speak up; however, it was too late. There was no one left to help...they all had fallen. Let's finally learn that unless we speak up together against tyranny and invasion, eventually, there will be no one left to speak up, for they've picked us off one by one.
We must stand together...Californians, North Carolinians, Texans, New Mexicans, Floridians, etc.--Americans! United we stand-divided, we're done.

I am a Native Californian...my Great Grandparents were born here. I have no plans on leaving here..I choose to stay and fight! To say that we are the land of "fruit and Nuts" isnt keeping with what we are all about here at ALIPAC. Come on ..quit bashing Ca and some other states and concentrate on what we are all here for....

Californians are not to blame, its the federal and state governments that allowed the current situation to happen by not enforcing the law all along.

The buck stops with us .

When I was a kid Americans would have shoved some flags where the sun don't shine when they got into our streets and faces . Also the first time some lib came into the class to teach their kids how to have sex in every crevice of the body, there may have even been some murders commited . So don't whine about it now , hit the streets . Take back your nation and defend your childrens innocence . I just had an argument with one of my brainwashed grandkids who was taught that any kind of romance is ok and not in a very good mood about it .

Judge backs Laguna Beach over day labor site

Insufficient evidence was provided to show the city's funding of the hiring site is illegal, according to a judge's proposed ruling.

Plaintiffs in a lawsuit over Laguna Beach's day labor hiring site failed to provide enough evidence to prove the city can't legally fund the site, according to a judge's proposed ruling.


The ruling came after Laguna Beach resident Eileen Garcia filed a lawsuit last year accusing the city of illegally funding the hiring center, which is currently run by the nonprofit South County Cross-Cultural Council. The suit alleged the city was not able to legally fund the site through community assistance grants because illegal immigrants were using it to find jobs.


But Orange County Superior Court Judge Gregory Munoz said there was not enough evidence to prove the city had "constructive knowledge" that illegal immigrants were getting work at the center and that the city wasn't liable for what South County did or didn't know about workers' status.


"We expected we'd win the case," said Laguna Beach City Manager Ken Frank. "We never thought we were doing anything incorrectly in the first place, so we're pleased and it will enable us to continue to have a day labor site in a good location and it doesn't impact our residents."


A number of agencies that run day labor sites have kept an eye on the case, which is one of two filed by Washington DC-based Judicial Watch – the other in Virginia.


Candice Jackson, the Judicial Watch attorney representing Garcia, said she would not object to Munoz's ruling but would appeal, arguing she has enough evidence to prove the city knew illegal immigrants were getting work there.


"We think there's plenty of evidence. It's going to be basically – can South County's knowledge be imputed to the city? And we say yes," Jackson said.
Chris Newman, legal director for the National Day Labor Organizing Network, said he wasn't surprised by the ruling and thought the case had more to do with the political debate over illegal immigration than issues of law. "If centers were illegal they wouldn't be opening up around the country at the rate they have," he said.


In Orange, the case has no bearing on the city's labor center since officials require U.S. identification from workers there, said David DeBerry, that city's attorney.

Laguna Beach opened its day labor hiring site in 1993 on a strip of land on Laguna Canyon road in response to residents' complaints that workers were congregating in their neighborhoods.


Garcia, an anti-illegal immigration activist who has long protested against Laguna Beach's center, said she wished her city would adopt a policy similar to that of Orange. She said she had expected the case would go to an appeal -- regardless of how the judge ruled.


"It would have been nice for me personally had it ended here, but I knew all along it was going to be long," she said.

Living in Morgan Hill CA I noticed all the fast food chains and retail stores hiring Hispanics, I was outraged and started questioning why - It was because the real estate market had spiraled out of control. You couldn't buy a shack for less than $500,000, landlords were raising rent at the average of $1000 a year. It was nothing to pay $1500 a month for a studio apartment, $3,000 for a small house. Who could afford to take a minimun wage job. Only Mexicans who crammed 10 people into one room. The rest of us had to commute to San Jose and work 70 hour weeks.

We didn't have time and were to tired to see what our politicians were doing. When we did complain we got no where.

We always had people that could fill those jobs through out the decades.

Now with the illegal invaders filling the jobs the Mothers and Fathers that did manage to have a child or two are seeing them with nowhere to go but into the military.

Why is it that people coming into the country illegal can afford to work these jobs but young people starting out in the work force can't?

Granted many of the illegal invaders are lock jawed leeches and bleed the system for social services while others in the house work for their beer money.

Distraction is how they do it . The sheep are all given large doses of entertainment and lots of idols to worship, works everytime !

Recipe for bringing down a nation .
Take away morals .
Bring in alians .
Access to easy credit
Replace fathers with fems
Confuse gender roles
Replace heros with idols
Take away absolutes, insert perversions

I can't say this. What about people like Raymond Herrera (ex-Marine, combat Vietnam War vet and Minutemen activist)? What about people like Colonel Al Rodriguez (founder of You Don't Speak for Me). I respect both these patriotic americans and I'm positive there are others.

Rationally I know you are right, but in my heart I am just hurt and distrustful. Growing up thinking we were all Americans, that ethnic origin or surname meant nothing. I am having a hard time dealing with the fact that I might have been wrong. The one thing I hate most is that this situation has busted my bubble. Gone are the days when I thought no matter what my neighbors, my politicans loved American and the American tradition as much as I do.

We're not ones to support public funding of many things, but it was hard to buy the argument made by two members of the anti-illegal-immigration Minuteman Project that Laguna Beach's city-funded day-labor center was illegal because illegal immigrants use it. Well, illegal immigrants use the roads, parks, schools and other public facilities, so it was no surprise that an Orange County Superior Court judge struck down the lawsuit.
According to published reports, the judge said that there was no way to prove that illegal immigrants use the center because the center does not ask for proof of immigration status, and that governments cannot be penalized for supposedly harboring illegal immigrants. The day-labor center in Laguna Beach has a bit of a contentious history, after a land-use battle over the site the city leases from the state. But this court battle was an attempt by activists, backed by a conservative judicial group, to bring the immigration debate to the local level.
In general, day-labor centers strike us as a reasonable, although far from perfect, way to deal with a legitimate public problem: what to do about immigrant day workers looking to get hired for various construction and gardening projects. Most of these workers are no doubt here illegally, as a past Register report concluded. But cities have only limited means to deal with the national immigration issue. They do have legitimate concerns about people who create traffic nuisances or who trespass on private property. The day-labor center provides an orderly way for people to sell their services to willing contractors and homeowners.
In an ideal world, private companies (perhaps some place such as Home Depot) would maintain and operate or at least fund these centers, although liability issues could be problematic. But in the meantime, we can think of worse ideas than having a place for day laborers to solicit work and better ways for activists against illegal immigration to pursue their cause.

First people need to stop taking things personal, people need to be honest and tell it like it is or you will never wake up America, ignoring a problem or sugar coating it will not change a thing.

I don't believe California is lost I believe it can be taken back, saved and turned into the once great state it once was.

I was born in Alhambra Calif, but left in 1980 why, because I could see what was happening and the people (Voters) (citizens) were not fighting back, they were being lead by politicans who told them they had to be diverse, so they allowed these people to lead them by the nose, as many other states have done and are doing right now.

It started with the schools for (Example) politicians said we need diversity in the schools, well you got it, I could see what was happening 25 years ago, now how many schools are 70 to 80 percent Hispanic, is anybody yelling about diversity now, no, so in other words diversity means any race can be the majority, as long as the Majority is not white.

We are all aware Calif. has alot of wonderful people my sister included, by waking up other states to what has happen to the southwest and Southeast, the more people in America we will wake up, and the more people you will have fighting on your side. So if it takes calling Calif. Texas and New Mexico and Florida a cess pool of 3rd world invaders, so be it, it is the truth.

Reality is harsh somethimes, but If you don't wake up the citizens in your states (since they are the voters) and get rid of the politicians who are running the states and not fighting for the citzens, you are screwed, and sugar coating it will not help get the job done!

Keep in mind you still have a beautiful state that is worth saving and "Remember the Alamo" Man I am full of them today huh!!! :wink:
