In a meeting today of the House Committee on Oversight and Government Reform, Chair Darrell Issa, R-California, and his colleagues will deal with the issue of subpoena power in the ongoing investigation into the DOJ-ATF gun smuggling scandal in which the Obama Administration placed over 1000 guns in the hands of Mexican drug cartels in order to claim U.S. guns are the driving force behind the violence. The Administration even cited those weapons as a motivation for massive new gun control laws, claiming that 90% of the guns used by the cartels came from the Unites States.
Those statistics were bogus.
When courageous and honorable agents of the ATF blew the whistle on the bogus scheme, Senator Charles Grassley, R-Iowa, began investigations into the allegations. He was met with blatant stonewalling on the part of the Holder Justice Department. The agency also refused to provide necessary documents for the investigation, even defying subpoenas.
The same thing happened when Darrell Issa embarked on his investigation in the House.
And that brings us to today's hearings of the House Committee. Issa wishes to address the subpoena power of Congress in its Constitutional mandate to provide oversight of the agencies of the Executive branch. It has been assumed that Congress has unlimited subpoena power, but the Administration has argued that it is not obligated to comply with subpoenas if the documents in question are part of 'ongoing investigations.'
However, a legal expert and former lawyer for the U.S. House of Representatives says otherwise:

"There is no special status under the law for the Department of Justice. The attorney general is an important member of the Cabinet, but he is no different than any other agency chief. He, too, is subject to congressional oversight," Steve Ross, formerly the top lawyer for the House of Representatives, told Fox News.
While the House committee's focus today is on Administration stonewalling, another hearing set for this Wednesday will deal with the family members of Border Patrol Agent Brian Terry who was killed with one of the smuggled guns, and three ATF whistleblowers who brought the entire fiasco to the attention of the news media.
Further, as St. Louis Gun Rights Examiner Kurt Hofmann states, the issue at stake is not whether or not the government engaged in this scandal. We already know it did. The question is why and what were they thinking.
Today's hearing is being covered by C-Span.

saw this on c-span at 3am. this is horrifying at best, that the ATF let these guns "walk", and now the drug dealing illegals down the street could easily have some of these guns. i hope this thing takes hussains little comedy show right down the pipes with it. they ALL knew what the ATF was doing.
