    Some Facts on US Citizenship If Born Abroad

    As of 2015, the "United States" includes all inhabited territories except American Samoa and Swains Island. (See § Citizenship at birth on the U.S. territories and former U.S. territories.)

    Birth abroad to two United States citizens

    A child is automatically granted citizenship if:

    Both parents were U.S. citizens at the time of the child's birth;
    The parents are married; and
    At least one parent lived in the United States prior to the child's birth. INA 301(c) and INA 301(a)(3) state, "and one of whom has had a residence."

    The FAM (Foreign Affairs Manual) states "no amount of time specified."

    A person's record of birth abroad, if registered with a U.S. consulate or embassy, is proof of citizenship. They may also apply for a passport or a Certificate of Citizenship as proof of citizenship.

    Birth abroad to one United States citizen

    A person born on or after November 14, 1986, is a U.S. citizen if all of the following are true:[10]

    The person's parents were married at time of birth
    One of the person's parents was a U.S. citizen when the person in question was born
    The citizen parent lived at least five years in the United States before the child's birth
    A minimum of two of these five years in the United States were after the citizen parent's 14th birthday.

    If you were born abroad to ONE U.S. citizen:
    In most cases, you are a U.S. citizen if
    all
    of the following are true:

    One of your parents was a U.S. citizen when you were born;

    Your citizen parent lived at least 5 years in the United States before you
    were born; and

    At least 2 of those 5 years in the United States were after your citizen
    parent’s 14th birthday.

    This is not a natural born citizen. A natural born citizen is born in the US to two citizen parents. This citizenship described above is citizenship created by the Naturalization Acts. A natural born citizen is someone not subject to the 14th Amendment or US Naturalization Law, which is why the conditions to be President or Vice President are born in the US to 2 US citizen parents so that our country is not the victim of foreign influence through the Oval Office.

    I truly hope our country can get straight on this. It's such a simple thing, but it is a very important issue for our country. Republicans have had 3 candidates just this election running for an office they know they aren't eligible for under the US Constitution. Yet they persist anyway putting their own ambitions above the will of the nation according to our Constitution. They go all Constitution until it gets in their own way, then they spin, play dumb, hand out bad jokes, ignore or blame the people raising the issue.

    Rubio, Jindal, Obama and McCain are not natural born citizens. They're citizens under either the 14th Amendment or the Naturalization Acts. If Americans want to change the Constitution to allow people who are children of non-citizens or born abroad to run for President, then we need to change the Constitution, not ignore it, not joke about it, not play dumb about it and not blame the people raising the issue.

    The reasons our Founders put this special condition in Article II for the offices of President and Vice President are as important today, if not more important than they were in 1789.
