A 37-year-old Middletown man was arrested for his third DUI offense Sunday afternoon. Middletown police said he was driving with a revoked license and had previously been deported twice.

Officers said a man who gave his name as Alfonso Herrera flipped his vehicle on its side around 3:40 p.m. Sunday on southbound Del. 301 near the Middletown Plaza Shopping Center. He told police he was trying to avoid hitting another car.
Police said they found him to be under the influence and driving with a revoked license. He was taken to Christiana Hospital, where police said they learned that his real name was Hector Arriaga-Gracida. He had been deported in 2007 and 2008 and was convicted of DUI in 2010, police said. There also was a warrant out for a second DUI under a different name.
He was charged with DUI, driving without a license and having a revoked license. He was committed to Young Correctional Institution after failing to post $2,500 unsecured bond.
Immigration and Customs Enforcement was also notified, and a detainer was issued for his being undocumented, police said.



How in the heck can peple get bail if they are an illegal invader to our country? This man could have killed several americans. He was deported twice and most likely wont be under obama. What are we going to have to do start branding illegals?

Thousands of our citizens have died because of illegals. Those same illegals had previous arrests and deportations. This guy will come right back with a new name and do as he pleases. Makes me sick!

A second DUI under a different name? And, they still can't figure out what is wrong with letting them flood in to the country. This is happening more and more and the current administration is still pushing amnesty, the DREAM Act and opening our borders through non-protection.

I doubt he can be denied bail, but he will not be released, because ICE put him o an immigration hold (detainer).

Except ICE is under orders to not deport anyone

I guess we have to wait until he kills someone before they decide to prosecute this dangerous criminal for felony re-entry! The United States is simply one giant playground for these invading criminals, where they do as they please with not a care in the world. They know NOTHING WILL EVER HAPPEN TO THEM.

My point is he is an illegal invader and has no rights. No one in the country legally should be able to get bail. They should get a one way ticket either home or on a sinking ship.
