Re.: Trial of BP agents Compean & Ramos

Dear Mr. Sutton,

You have clearly stated - “ My office would have much preferred to see Aldrete convicted and sent to prison for his crimes. We are in the business of putting bad guys like Aldrete behind bars. In fact this office leads the nation in the number of drug smuggling cases we prosecute. Because agents could not identify him, found no fingerprints, could not tie him to the van and did not apprehend him after shooting him, the case against Aldrete could not be proven”

At a press conference you stated, “We have no evidence – if someone has some evidence this van driver, that this illegal alien committed a crime, I would be happy to have it, because I would be happy to put this guy in prison for as long as we possibly can.”

I have the following questions ?

Why did it take a month before the smuggler’s van was checked for finger prints ? What was the result of this check ? I understand it was performed by the El Paso Police Dept. and not the FBI. Can you furnish me a copy of this report or tell me from whom, I need to request it ?

I understand from the trial transcripts a cell phone was found in the drug smuggler’s van. Why did this piece of evidence fail to provide a link to the drug smuggler ? I understand this phone was given to the DEA. Can you furnish me a report regarding the results of the investigation of this piece of evidence or tell from whom, I need to request it ?

Is it true that the drug smuggler admitted to a border patrol agent, before he was given immunity, that he was indeed a drug smuggler ?

I understand a DHS investigator testified in the trial the drug smuggler violated the terms of his immunity agreement. When he violated his agreement, why did you fail to arrest him and charge him ? In Oct. of 2005 , Alddrete-Davila was indicted for smuggling 1,000 of marijuana. Yet this indictment was expunged ? Why ? He was in custody and in a federal courtroom, yet you failed to do this. You had evidence of his 2nd crime and you refused to put this guy in prison for as long as you possibly can.
