TUCSON, Ariz. (KGUN9-TV) - More than two-and-a-half months after someone shot and killed Border Patrol Agent Brian Terry in the Southern Arizona desert, there's finally a tiny bit of solace for his father Kent and step mom Carolyn. They're getting some answers from an FBI search warrant.

However, with solace comes more questions for the Terry family. For them, some of the discrepancies and conflicting reports they've gotten since the shooting just don't add up.

The Terrys say that on the night of Brian's funeral, officials told them there were eight suspects in the shooting, and they were all carrying AK47s. The affidavit states that there were only five suspects with two guns, and that Border Patrol agents fired bean bag guns first. When the suspects fired back with real bullets, two agents then returned fire with a long gun and a pistol.

There is no indication in the warrant that Brian ever fired a shot, but the Terrys say an autopsy report they received revealed their son was shot once in the back.

"How difficult is it to hear that your son was hit like that?" KGUN9 asked.

"Oh, that's sad," replied an emotional Kent. "Can we go back to that question later? I can't answer you right now."

But tears quickly turned to anger as he replied, "I'll tell you the truth, I think my son was set up. I think he was set up!"

"I know two weeks prior to his death he (Brian) was out there looking for dirty agents!" added Carolyn, citing a conversation she had with Agent Terry prior to his death.

Carolyn also described a conversation she had with officials on the night of Brian's Tucson memorial. She recalled them saying there was no friendly fire involved. "So my first question was 'what about dirty agents?'" she said. "And their eyes all got real wide. And they kind of looked at each other like 'we've been caught' type thing."

KGUN9 wants to emphasize that there is absolutely no hard evidence to back up the Terrys' suspicions. KGUN9 did reach out to the FBI, but they would only say that the investigation is ongoing.
