Congressional candidate Mark Assini is calling for more security following a serious crash involving an illegal alien.
Assini expressed outrage over a crash that occurred on Christmas Eve. According to investigators, Efrain Lopez-Contreras crossed the center line and struck a SUV head-on. The SUV caught fire in the crash and the victims were pulled out by Good Samaritans. We're told Lopez-Contreras attempted to leave the scene of the crash.

Lopez-Contreras was charged with DWI and vehicular assault. Deputies say Lopez-Contreras is an illegal alien who was previously deported.

Supervisor Mark Assini wants to see the federal government take a hard look at border patrol, law enforcement and programs that allow immigrants into this country. So we can figure out how it was that a man previously deported got back into this country.

"This is not an isolated incident," says Mark Assini. "If the Rochester residents and Monroe County residents don't know; we have a problem, and a significant problem with immigration, right in our area."

Gates Supervisor Mark Assini points to the New York Times which has reported that our region has one of the highest arrest rates for illegal immigrants. Each year, hundreds of people are taken into custody who are living in the greater Rochester community. Assini says it is something we have to take seriously.

"We've had individuals, in one case, deported four times -- four times -- and came back to attempt to kill two individuals, stabbing both of them," says Assini. "We've had incidents were an illegal alien had 37 criminal convictions and was allowed to stay in our country."

"How did this individual get back into the U.S. after being deported," asks Assini. "Who was housing him? He had to have housing. Did someone rent him a unit? Did someone give him a space?"

We checked and Homeland Security cannot release why Lopez-Contreras was deported, or how they believe he got back into the country, citing privacy laws. We went to the Batavia house listed as his address. A woman came to the door and said he doesn't live there but is the father of her son.

Amanda Ciavarri: "Do you know how he got back into the country?"
Woman: "I can't talk about any of that."
Ciavarri: "Do you know why he was deported originally?"
    Woman: "No."

Assini says we, as a community, need to push for answers, so any loopholes can be fixed.

"The more information we have, the more power we have the ability to address the issues that allowed this individual to come back into the country," he says. "Further, I think people that are assisting criminals that are deported and come back into the country should also face some sort of punishment."

Supervisor Assini says the power is now in the hands of the voters. He says people need to reach out to our federal elected officials and push them take a hard look at immigration.

"We cannot ignore the fact that border security or, lack of it, nearly took the lives of a Rochester family, Assini said. “The public deserves to know what flaws exist in border security and that solutions are being formulated to address those flaws. The federal government must tighten border security now before another local family is victimized.”
