    Texas likes to brag about wooing businesses away from California, so you're welcome, Rick Perry, for the Lone Star State's latest plucking from the Golden State: an Orly Taitz lawsuit.


    Yes, as the Valley Morning Star reports, the Rancho Santa Margarita-based lawyer/dentist/real estate saleslady/cartoon character has filed suit in a Brownsville federal court challenging the transfer of undocumented immigrants from South Texas to California and other states.


    "This is nothing short of an orchestrated invasion, perpetrated to supply cheap labor for a group of billionaires and flagrantly rob American citizens of their jobs, wages and benefits and expose them to epidemics of infectious diseases and crime," claims the complaint.


    The Queen of the Birfers alleges these folks will spread epidemics of scabies, tuberculosis, measles, whooping cough, swine flu, dengue fever, Ebola virus and lice in her complaint that was filed July 14.


    "As if this weren't bad enough, the invasion is also supplying the nation's most dangerous street gangs with new soldiers," the suit further charges, claiming that gangs are on a "recruiting frenzy" at facilities housing the undocumented immigrants.


    The "dumping" of undocumented immigrants poses threats to the economy and national security, maintains the complaint, which names as defendants her usual target President Barack Obama as well as the Department of Homeland Security Secretary Jeh Johnson, Health and Human Services Secretary Sylvia Burwell and the U.S. Border Patrol, Rio Grande Valley Sector.


    Presiding U.S. District Court Judge Andrew S. Hanen ordered the defendants to respond to Taitz's request by today to either immediately deport the immigrants or confine them to a two-month quarantine in enclosed temporary or permanent federal facilities.


    The defendants were also directed by Hanen to notify the California Attorney General's office about the lawsuit and deadlines so that it may take part in the latest Or-lunacy if desired.


    Actually, if a settlement could be worked out where the government will comply with Ms. Taitz's wishes in exchange for her permanent residency in Texas, it might be worth it.

    BROWNSVILLE — The US Justice Department said California dentist and attorney Orly Taitz, who is challenging the transfer of undocumented immigrants from South Texas to other states, has no standing to bring the lawsuit and that she only seeks to entangle the judiciary in her political quarrels.

    Taitz filed a civil lawsuit on July 14 in federal court naming President Barack Obama, Secretary of the Department of Homeland Security Jeh Johnson, Secretary of Health and Human Services Sylvia Burwell, and the U.S. Border Patrol, Rio Grande Valley Sector, seeking to stop the “dumping” of undocumented immigrants on unsuspecting populations in California and other areas in the country.

    She cited economic damages, and serious threats to public health and safety, spread of infectious diseases, and national security.


    She alleges that the undocumented immigrants spread epidemics of scabies, tuberculosis, measles, whooping cough, swine flu, dengue fever, ebola virus, and lice.


    She seeks either the immediate deportation of undocumented immigrants or that they be held in quarantine for two months in an enclosed temporary or permanent Federal Emeregency Management Administration facility.


    “(Taitz) is unhappy with policy decisions that are firmly within the secretary’s discretion and thus asks this court to replace the agency’s expertise in enforcing and administering the nation’s immigration laws with her own enforcement priorities,” the government’s attorney Colin A. Kisor, acting director in the Justice Department’s civil division of stated in the government’s response to Taitz’s lawsuit. The response was filed late Friday.


    “This is precisely the sort of ‘broad programmatic attack’ that the Supreme Court has deemed inappropriate, especially where ‘the manner (of agency) action is left to the agency’s discretion’,” Kisor further wrote.

    A hearing is scheduled for August 27, 2014, Courtroom 6, US District Court, 600 E. Harrison, Brownsville TX. Please, see attached the order by Judge Hanen. Witnesses will be allowed to appear.

    Orders by Judge Hanen and pleadings by the parties are attached below. Plaintiff is a doctor and attorney, Orly Taitz, [who] is seeking a two months quarantine of illegal aliens caught at the border. The quarantine is necessary for treatment and prevention of spread of infectious diseases in [the] population and particularly in schools. Further[more], Taitz is seeking an order by the court to either turn around and deport illegal aliens caught by the border patrol, or a written medical release, [the] criminal record from the countries of origin, and an order by the immigration/deportation judge finding legal basis for U.S. residency, prior to release of such illegal aliens into the general population. Today, with the threat of Ebola, drug resistant Tuberculosis, Scabies, Measles, Bacterial meningitis and other infectious diseases, such [an] order is a necessity.

    In prior cases, [the] presiding judge, Andrew Hanen, already expressed his deep concern with the policies of [the] Obama administration acting as human smugglers and aiding and abetting drug cartels in human smuggling of illegal aliens. In the case at hand, Judge Hanen already issued to defendants, Barack Obama, Secretary of Health and Human Services Sylvia Burwell, and Secretary of Homeland Security,Jeh Johnson, an order to show cause, why shouldn’t he rule in favor of Plaintiff Orly Taitz and grant her application for stay of all trafficking of illegal aliens and [to] stay implementation of DACA (Deferred Action on Child Arrivals), which has been a magnet and an incentive for hundreds of thousands of illegal aliens to cross the U.S. border and violate U.S. immigration laws and U.S. sovereignty.


    Attorney Orly Taitz is asking the public to assist her in securing appearance of witnesses, among them Border Patrol officers, sheriffs and medical professionals, Texas ranchers and others, who are affected by this lawless open border policy of Obama administration. Additionally, Taitz is asking the public to contact Governor Perry, Senator Ted Cruz, [and] Congressman Louie Gohmert, to see it they are willing to testify at the court hearing about the negative effect of this dumping of illegal aliens.

    Judge Denies Restraining Order in Immigration Case

    A federal judge in Texas denied Wednesday a conservative activist's request for an emergency stay to stop the government from transporting immigrants who entered the country illegally in South Texas to other states or releasing them on their own recognizance.


    In a complaint filed in July, Orly Taitz argued that by sending immigrant children and families to various states while South Texas was overwhelmed by an immigration surge, the U.S. government created a public health risk.

    She called for a two-month quarantine and medical screening for all immigrants detained after entering the country.


    U.S. District Judge Andrew Hanen on Wednesday told the dentist and lawyer from Rancho Santa Margarita, California, that she could refile an amended complaint. He said he was denying her request for an emergency stay because he was not convinced the lawsuit would succeed with Taitz as the plaintiff.


    "The only way I see this going forward beyond this next step is that you're going to have some expert support for your damages," Hanen said.


    Taitz said that she participates in several programs that provide dental care to new immigrants. She said many of them came in with a persistent cough and she subsequently developed an upper respiratory infection. She also said Border Patrol agents were infected with scabies and chicken pox while handling immigrants.


    Taitz is best known as a proponent of the debunked "birther" movement that questions whether President Barack Obama was born in the United States.


    The government had sought to have the lawsuit dismissed and indicated Wednesday it would continue to do so. In a court filing, the government called the lawsuit "nothing more than a generalized grievance" and noted that the federal government has broad power in the area of immigration.


    From October to July, 63,000 unaccompanied children were arrested after entering the U.S. illegally, double the number from the same period a year earlier. Another 63,000 families — mothers or fathers with young children — were arrested during that period.


    Those arrests have slowed, however. Arrests of children traveling alone and children and parents traveling together dropped by about half in July from the previous month.


    Law requires unaccompanied children be transferred from Border Patrol custody to the U.S. Department of Health and Human Services Office of Refugee Resettlement within 72 hours of their arrest. During the surge, Border Patrol stations were clogged with children, forcing the agency to transfer some immigrants from the Rio Grande Valley to other sectors along the Southwest border. Some families were released with orders to appear later before immigration officials.


    In Hanen, Taitz found a judge who had voiced his own criticisms of the government's willingness to reunite children who entered the country alone with parents already residing in the U.S. illegally. In an order issued in another case in December, Hanen wrote that the U.S. Department of Homeland Security is assisting in criminal conspiracies to smuggle children into the country by doing so.


    It was Hanen who asked some of the most pointed questions of the representatives from the federal agencies most directly involved in handling the increase in immigrant children and families during the hearing Wednesday.


    Representatives of the Border Patrol, Immigration and Customs Enforcement and the Office of Refugee Resettlement each testified about the medical screenings that immigrants undergo.


    Kevin Oaks, the Border Patrol's chief of the Rio Grande Valley sector, conceded that some immigrants with scabies had been transferred to other states but maintained that the agency's screening was effective. Teresa Brooks, who oversees the Office of Refugee Resettlement's operations in the Rio Grande Valley, said she knew of only one case in which a child tested positive for tuberculosis during the immigration surge.


    Hanen gave Taitz until Sept. 12 to file an amended complaint.
