Zee Fatal Flaw Of Z Visas(Vanity)

I want to pose a rather important and alarming issue to fellow Freepers and others. It's a problem with the Z Visa that I've yet to hear mentioned by a single MSM news reporter or news story. Yet it is a monumental and frightening problem that belies all of the proponents' mendacious statements about the added security we'll gain from "Comprehensive Immigration Reform".

Among its many egregious flaws and insane propositions, "Comprehensive Immigration Reform" includes the issuance of the "Z Visa" to illegal aliens who "were illegally in the U.S. before January 1, 2007." (Administration-Proposed Substitute to S. 1348, May 22, 2007) Estimates of the illegal alien population in the United States range widely, from the low end of 12,000,000 to a high estimate of 20,000,000. The vast majority of those aliens present in the U.S. prior to Jan 1, 2007 will be eligible for the Z Visa.

Discussed in great detail on FR and many Internet blogs, the Z Visa provides illegal aliens with de facto permanent residence in the U.S. as well as work authorization. There are many dubious flaws with the Z Visa, but I want to focus on only one of those problems in this post. It's a doozey.

Arguably the most serious problem with the Z Visa is the process by which they will be issued, and who gets one. To understand the inadequacy of the process, let's first look at legal immigration under a typical "family-based visa", which could be for a spouse or one's minor children.

The State Department (not the Customs & Immigration Service of DHS) administers the issuance of permanent resident visas for the U.S. and has a lengthy checklist of long-established requirements for qualification. In addition to a confirmed lawful family relationship with a U.S. citizen or a lawful permanent resident, the applicant must jump through a great many hoops which support a safe and rational set of immigration standards. All of these checks are conducted in the applicant's home country, and must be completed, validated, and approved prior to the issuance of an immigrant visa.

To wit, applicants must undergo medical checks - at a State Dept.-approved hospital - for TB, STDs, general physical health, and mental health; they must obtain vaccinations for MMR, flu, and several other communicable diseases; they must obtain a local, home country criminal background clearance; under some conditions they must get an official financial release from the home country to prevent "skipping" on any outstanding bank loans; they must be eligible to obtain a home country passport and, if necessary, an exit (or sometimes "emigration") visa.

In addition to all of that, the applicant must also obtain from his or her "sponsor" the required "affidavit of financial support" ensuring that he or she will not become a public charge in the U.S. *(aka "welfare recipient"), as well as several years of certified IRS tax returns establishing the sponsor's income and ability to support the immigrant.

Finally, the applicant must appear at the U.S. Consulate in their home country for an extensive and in-depth personal interview with a State Dept. "adjudicator" and a U.S. (State Dept.) witness and/or translator if necessary. Adjudicators can and do deny visa applications if all of the foregoing requirements are not met in whole, and/or if any "suspicious" issues are revealed during the course of the interview. Among the issues covered are criminal activity, family relations, political views and associations, moral character, etc.

It is only after successfully meeting each and every one of the State Dept. requirements that a visa is approved and issued.

Compare that rather extensive approval and vetting process to that required for a Z Visa.

As noted above, all illegal aliens here before 1/1/2007 are presumed eligible (an affidavit from a friend and a dated receipt from a money transfer shop are the only documents needed to establish the required "presence"). Aside from that, there's not much else needed. There is no requirement for sponsorship or financial support. There is no need for vaccinations or for any physical or mental medical checkup and clearance. There is no financial background check or clearance to determine solvency, bankruptcy, illicit activity, or any other financial red flag. There is no provision for a verbal interview and clearance by an experienced and official adjudicator. There is no need to declare one's political associations or beliefs, or to express any affinity whatsoever for the United States.

As any reader would logically conclude, the "vetting" process for the Z Visa is almost nonexistant, and most certainly it makes a mockery of the grueling process endured by lawful and legal immigrants who are following the established rules.

There is really one and only one vetting activity pertinent to Z Visa applicants, and that is the asserted clearance through a criminal background check.

Those following the debate already know of the laughable "2 business day" requirement for criminal clearance, which by law gives the Z Visa applicant a provisional approval in lieu of any negative response within 2 business days. We'll set that ludicrous problem aside for now, because there is actually a far more dangerous and fatal flaw with this joke of a criminal vetting system.

The fatal and extremely alarming problem with the Z Visa is that the criminal background check, according to all public reports and not contradicted by anything in the law, is initiated by submitting the applicant's fingerprints to the FBI and (presumably) an inquiry to the National Crime Information Center (NCIC).

This would all be well and good if the applicant had spent most of his or her life in America, and had been fingerprinted and properly identified at some point in the past.

But quite the opposite, most illegal aliens have not been here for more than a handful of years, and have never been fingerprinted in America. They have most spent most of their lives in their home countries, which will NOT be involved in Z Visa criminal inquiries or approvals. It also is extremely unlikely that, for example, the belligerent Mexican government would allow or provide any cooperaton with our criminal background check even if it did maintain accurate criminal records.

Thus, the 25- or 30-year-old robber, rapist, murderer, con-man, or thief who's been in the U.S. since July 2006 will handily pass the presence test, and is very unlikely to be flagged in the criminal background check (which will be focused on criminal activity in the U.S. and not in the applicant's home country).

Let's not forget that the Z Visa is "nondiscriminatory' (or better said, completely indiscriminate) in embracing the illegal alien. The visa is not only for Mexicans, nor is it restricted to Mexicans and Hondurans and Guatemalans. The Z Visa is for everyone, of every nationality, so long as they are provably illegal aliens now in the U.S., and they can meet the 1/1/07 presence test.

So if you're a Chinese intelligence agent or Japanese Yakusa or a Russian career criminal or a Parisian prostitute you should by no means feel left out of America's new Global Identity Program. Come on over! Grab some false "presence test" documentation, buy your ticket, and welcome! Your Z Visa is fast on the way to your new American home.

Now in the event you're even remotely concerned about being identified in your home country at some point in the future by the criminal background check, and having your Z Visa yanked due to some silly old criminal charge, here's a tip: use that time-honored ruse of the illegal alien, a false name.

(We will address the trivial problem of your U.S. Visit thumbprint at a later date, but don't worry, it can easily be overcome)

Application for a Z Visa appears to require no corroborating identification of any kind, so feel free to make up a new name, city of birth, and birth date. You can get more elaborate if you wish, but those are the basics. And don't worry about getting tripped-up, since you'll have no identification, no passport, or anything at all proving that you're not who you say you are. The U.S. Z Visa is uniquely generous throughout the world in accepting that you are who you say you are, with no ifs, ands, or buts. If the CIS folks ask you for ID or a passport, just say "No have." If they ask for your bank card, "No have." If they want anything beyond that affidavit and money transfer receipt, remember to say "No have."

"No have" will be your key to American permanent residency, or to a new American identity if that's all you seek (remember, your Z Visa allows you to travel, so you shouldn't hesitate to return home for a new passport under your "new" name, using your Z Visa for proof of identity).

As you might imagine, the U.S. Z Visa has benefits far beyond those intended by the U.S. Congress and President George Bush. It will be inexpensive to apply, easy to qualify, and certain to give you many years to assume a new second identity.

For those who intend to stay in America to accomplish the "big things" mandated by their religion, the Z Visa will provide "bulletproof" (no pun intended) cover while you refine your plans. Mixed-in with 15 or 20 million other applicants, it's more than unlikely that you'll draw any unwanted attention from American counterintelligence agencies. While you're building your dispenser for "a summer cold" and getting those last kilos of "the glowing powder", just remember that America has paved your way with a program that could only have come from God himself.
