15 immigrants protected from deportation arrested in national sweep for criminals

    Associated Press March 12, 2015 | 5:18 p.m. EDT

By ALICIA A. CALDWELL, Associated Press

WASHINGTON (AP) — Federal agents in a sweep targeting dangerous criminal immigrants arrested 15 people who have been allowed to remain in the U.S. under a program intended to protect children who came to the U.S. years ago with their parent.

A U.S. official briefed on the arrest says 14 of the 15 had been convicted of a crime.

In at least one case, the Obama administration renewed the protective status for a young immigrant after that person was convicted in a drug case.

One eligibility requirement for the program is that immigrants not have a criminal history.

The official spoke on condition of anonymity because this person was not authorized to discuss the matter by name.

It was not clear when 13 of the immigrants were convicted or what their crimes were.

15 immigrants protected from deportation arrested in national sweep for criminals

FILE - In this July 10, 2013, file photo House Judiciary Committee Chairman Bob Goodlatte, R-Va., speaks with reporters at the Capitol in Washington. Federal agents in a sweep targeting the most dangerous criminal immigrants arrested 15 people who have been allowed to remain in the U.S. under President Barack Obama's executive action intended to protect children who came to the U.S. years ago with their parents, The Associated Press has learned. "With few fraud detection measures and effective background checks in place, it's no surprise that ICE arrested over a dozen DACA recipients last week, most of whom had already been convicted of a crime," said Goodlatte. "I and other members of the House Judiciary Committee have expressed concern about this for years." (AP Photo/J. Scott Applewhite, File)

WASHINGTON (AP) — Federal agents in a sweep targeting the most dangerous criminal immigrants arrested 15 people who have been allowed to remain in the U.S. under President Barack Obama's executive action intended to protect children who came to the U.S. years ago with their parents, The Associated Press has learned.

Fourteen of the 15 had been convicted of a crime, a U.S. official briefed on the arrests said. In at least one case, the Obama administration renewed the protective status for a young immigrant after that person's conviction in a drug case.

One of the eligibility requirements for the program is that immigrants not have a criminal history. The official spoke on condition of anonymity because this person was not authorized to discuss the matter by name.

It was not immediately clear when 13 of the immigrants were convicted or what their crimes were. They were arrested by U.S. Immigrations and Customs Enforcement. The answers to those questions could undermine the integrity of the government's program, since eligibility is reserved for ambitious, young immigrants enrolled in school or who graduated and who would benefit American society.

None of the names of the immigrants was disclosed. One of the young immigrants arrested hadn't been convicted of a crime, but was arrested after being found armed with a gun, the official said.

Under the program, known as Deferred Action for Childhood Arrivals, or DACA, more than 675,000 young immigrants since August 2012 have been granted a work permit and reprieve from deportation.

"With few fraud detection measures and effective background checks in place, it's no surprise that ICE arrested over a dozen DACA recipients last week, most of whom had already been convicted of a crime," said House Judiciary Committee Chairman Bob Goodlatte. "I and other members of the House Judiciary Committee have expressed concern about this for years."

Goodlatte, R-Va., and other Republicans have long decried Obama's executive immigration as a form of backdoor amnesty that circumvents Congress.

ICE did not respond to telephone messages and emails from The Associated Press.

The sweep also captured five immigrants with protective applications pending and 19 others who had already been denied protection from deportation under the program.

Earlier this week ICE Director Sarah Saldana said the operation focused on "the worst of the worst criminals."

"This was a targeted enforcement operation, aimed specifically at enhancing public safety," Saldana said. "It exemplifies our core mission, by taking dangerous criminals off the streets and removing them from the country we are addressing a very significant security and public safety vulnerability."

ICE agents arrested 2,059 convicted immigrants, including more than 1,000 people who had multiple convictions. More than 98 percent of those arrested in the weeklong operation were a top priority, Saldana said.

In November, Homeland Security Secretary Jeh Johnson announced new deportation priorities as part of Obama's planned expansion of programs to shield millions of immigrants from deportation.

The top priority includes immigrants suspected of being terrorists, gang members, convicted felons and those caught crossing the border illegally. The second priority includes immigrants convicted of three or more misdemeanors or a single serious misdemeanor, such as drunken driving or domestic violence.

Homeland Security Department documents say participation in the program can be revoked at any time. U.S. Citizenship and Immigration Services, which approves applications, reported to the House Judiciary Committee last year the government stripped that protection from 113 people as of August. The revocations included one case of gang membership, one aggravated assault, 11 driving-under-the-influence cases and 11 errors by USCIS, according to the committee.

Obama's planned expansion of the protection programs has been put on hold by a federal judge in Texas presiding over a lawsuit filed by 26 states to stop the effort. In February Judge Andrew Hanen temporarily blocked the expansion plans, which included granting protections and work permits to parents of U.S. citizens and legal permanent residents. On Thursday the U.S. government asked an appeals court to lift the temporary hold on the expansion.

It's so much easier to find them after they sign up for DACA and give their name, address and phone number.

Feds Arrest 14 DACA Temporary Amnesty Recipients with Prior Criminal Convictions

    by Breitbart News
    12 Mar 2015
Federal agents have arrested fourteen DREAMers who received temporary amnesty under President Barack Obama’s 2012 Deferred Action for Childhood Arrivals (DACA) who had previously been convicted of crimes.

According to an Associated Press report, “federal agents in a sweep targeting the most dangerous criminal immigrants arrested 15 people” who had received temporary amnesty.
A U.S. official who was briefed on the arrests told the Associated Press that 14 “of the 15 had been convicted of a crime.” And “in at least one case, the Obama administration renewed the protective status for a young immigrant after that person’s conviction in a drug case,” according to the AP source. The fifteenth DREAMer “hadn’t been convicted of a crime, but was arrested after being found armed with a gun.” The sweep reportedly “also captured five immigrants with protective applications pending and 19 others who had already been denied protection from deportation under the program.”
The Associated Press noted that “it was not immediately clear” when the DREAMers “were convicted or what their crimes were” and “answers to those questions could undermine the integrity of the government’s program, since eligibility is reserved for ambitious, young immigrants enrolled in school or who graduated and who would benefit American society.”

Nearly 700,000 illegal immigrant DREAMers have been granted temporary amnesty and work permits since the program went into effect in August 2012.

According to the federal government, DREAMers can qualify for DACA only if they “have not been convicted of a felony, significant misdemeanor,or three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.”
When announcing his new executive amnesty for the illegal immigrant parents of U.S. citizens last year and expansion of the DACA program that lifted the upper age limit, Obama emphasized that temporary amnesty recipients must pass criminal background checks.

“So we’re going to offer the following deal: If you’ve been in America for more than five years; if you have children who are American citizens or legal residents; if you register, pass a criminal background check, and you’re willing to pay your fair share of taxes — you’ll be able to apply to stay in this country temporarily without fear of deportation,” he said. “You can come out of the shadows and get right with the law. That’s what this deal is.”

At a recent Senate Judiciary Immigration and the National Interest Subcommittee hearing, Sen. Jeff Sessions (R-AL) pointed out that it would be nearly impossible to vet executive amnesty applicants for past criminal activities or ties to gangs. He added that federal officials do not even have the resources or standard operating procedures to verify the identities of applicants who, for instance, do not have a middle initial on their application but submit suspicious documents with a middle initial
As Breitbart News reported, Sessions told top United States Citizenship and Immigration Services (USCIS) officials that they have been “asked to do more than is physically possible” and Obama should have never asked them to vet executive amnesty applicants for criminal activity when they do not have the resources to do so.
“You just don’t have the ability to do this,” Sessions said, noting that legal immigrants are put through more rigorous backgrounds check than illegal immigrants applying for temporary amnesty.

When officials testified that USCIS has a “layered” process where applications are read by different people and amnesty applicants would not be given in-person interviews, Sessions called it a “dangerous” process for an agency that has already been accused of “rubber-stamping” applications.
“You don’t have any staff to do those interviews,” he said. “This is not going to work. You know it and I know it.”

After federal judge Andrew Hanen issued a temporary injunction against Obama’s executive amnesty, the administration halted the program until the case is resolved. The Obama administration on Thursday asked the 5th Circuit Court of Appeals to block Hanen’s injunction in an emergency filing.

It should be a separate felony crime for illegal aliens to bring or send their children to the United States, and it should be a separate felony for each child they bring or send. They should also be charged under existing law for child endangerment as well as contributing to the delinquency of minors. That would be 3 felonies per child. That's what they would charge Americans with, so illegal aliens should be charged with the same crimes and the children need to be returned immediately to the custody of their foreign government, the same way children of Americans are handled by our government.

We would also be wise to link aid and trade to this policy. I doubt that 'Bamacrats are prepared to insist on putting the safety of Americans above pandering to illegals advocates. But patriots can at least try to influence the decisions of foreign politicians.

Oh absolutely! I totally agree vistalad. And also individual remittances. Foreign aid, trade and individual remittances should all be leveraged against the home countries who encourage illegal immigration into the United States. Oh yes. We need that policy desperately, because after all these years, I'm convinced that the cartels are behind all of this. They work their own governments to take this attitude that it's a civil right of their citizens to break the law of our country, and even aid and abet the emigration with the governments glad to be rid of these particular folks, and the cartels who want the illegal alien drug runners and business operators to run this huge trade in our country.

When I think of illegal aliens and what drives them, I keep coming back to the question could it be a Narcissistic-led form of Bi-Polar disease.
