Georgia appeals injunction banning recent anti-illegal immigration law

Georgia will continue to fight a ban on a recent anti-illegal immigration law that was struck down by a district court.

Georgia Attorney General Sam Olens filed an appeal Monday against civil rights groups, including the American Civil Liberties Union (ACLU) and the National Immigration Law Center (NILC), that sued to overturn HB 87.

The law would allow police to question criminal suspects about their immigration status, a controversial power currently under debate in other states as well. The law, which was scheduled to go into effect at the start of July, would also fine those transporting illegal immigrants.

Now, Olens and Georgia Gov. Nathan Deal will push the case to the U.S. Court of Appeals for the 11th Circuit where he argues the lower court injunction was improper given the plaintiffs "failed to show irreparable injury."
