22-year-old man suspected in brutal stabbing now jailed

The 19-year-old victim of an April 14 knife attack in Norton Shores has a severed spine that left him permanently paralyzed, authorities say.

And the man charged with repeatedly stabbing Josue Emmanuel Chacon is back in jail -- following more than a week of freedom -- after a Muskegon judge sharply hiked his bail Thursday. The judge was reacting in part to the revelation that attempted-murder suspect Jesus David Elizalde is an illegal immigrant from Mexico, and therefore, a potential flight risk.

Sixtieth District Judge Harold F. Closz III granted a motion by the Muskegon County Prosecutor's Office to increase Elizalde's bond from $25,000 to $200,000 cash or surety. With his family unable to post the higher amount, Elizalde was taken into custody in the courtroom and later lodged in the Muskegon County Jail.

Elizalde, 22, of 122 Maplewood in Muskegon Heights, is charged with assault with intent to murder. Authorities say he stabbed Chacon nine times in a mobile home at Pontaluna Shores, 1281 E. Pontaluna.

Elizalde and his 20-year-old wife are in the process of getting a divorce, police said, and the attack took place at her home when Elizalde allegedly burst in and found Chacon sitting on the couch with her. The suspect turned himself in at a gas station at Henry Street and Norton Avenue the same night.

Police said a pistol was found on Chacon but was never fired.

The victim remains in a West Michigan hospital after suffering multiple stab wounds to the face, back, stomach and chest in the attack at Lot 139.

Most serious was the spinal injury.

"(Elizalde) did sever the victim's spine," said Chief Trial Attorney Leslie C. Bowen of the prosecutor's office, in arguing for the increased bond. "I'm told the victim is never going to walk again."

Outside court, attorney Michael G. Walsh, who is representing Chacon's family in civil matters, said Chacon's spine was cut in the chest area, leaving the teen-ager a permanent paraplegic with no voluntary use of his body below the chest. "As a result, he is suffering from depression," Walsh said. "But it's a very close-knit family, and they're meeting with him on a daily basis. So we anticipate he will recover to the degree that he'll stabilize. But he'll never walk again."

In court arguing for the raised bond, Bowen revealed details of the case not previously made public. The prosecutor said Elizalde's wife -- who is fully cooperating with authorities -- told police that Elizalde told her during the attack: "As long as I'm going to go to jail anyway, I might as well finish him off."

Bowen said the attacker's wife was finally able to persuade him to stop stabbing Chacon by promising not to identify him to police, among other promises.

In addition, Bowen said, "He is, in fact, an illegal alien" -- an undocumented immigrant from Mexico."

Defense attorney West argued that Elizalde has no prior criminal record and poses no threat to anyone, implying that the multiple stabbing was in self-defense because Chacon had a handgun: "Use of deadly force in self-defense excuses the deadly force," West said. He also argued that Elizalde does not pose a flight risk, as evidenced by his showing up for Thursday's scheduled motion hearing and preliminary examination.

But under questioning from the judge, West could not deny that his client was an illegal alien. He said Elizalde has lived in the United States 11 years but never obtained immigration papers.

That -- combined with the number of stab wounds and the severity of the victim's injuries -- persuaded Closz to boost the bond.

Elizalde waived his right to a probable-cause hearing Thursday before Closz. The judge ordered him bound over for trial in 14th Circuit Court.

Walsh said Chacon's family, too, are immigrants from Mexico, but "they're legal."

I used to go to Muskegon as a kid and to Silver Lake. Wow, this stuff is everywhere. No wonder so many people are vocal about this situation. I never would have imagined the troubles had traveled there.

It's a pity the government ignores these very common types of incidents.
