Trucker in ammo case is taken to Mexico City

U.S. trucker who was detained this week by Mexican authorities with 268,000 rounds of ammunition has been taken to Mexico City by federal investigators specializing in organized crime.

Jabin Akeem Bogan, 27, was flown to Mexico City on Thursday morning by personnel of the organized crime special investigation unit of the Mexican Attorney General's Office, or PGR, said José Angel Torres Valadez, spokesman for the agency in the northern region.

The investigation will continue there, he said.

Bogan was arrested Tuesday afternoon at the Córdova-Americas international bridge after Mexican customs officers inspected his tractor-trailer and found several boxes containing the ammunition. The seizure was one of the largest by Mexican authorities in Juárez in the past four years.

The bullets were calibers 7.62x39 and 5.56x45, which are commonly used with AK047 and AR-15 rifles. They are often used by members of Mexican criminal organizations.

On Wednesday, Dennis Mekenye, owner of Arlington-based Demco Transportation Inc. and Bogan's employer, said his driver took a wrong turn that accidentally landed him in Mexico.

The cargo was being hauled from Johnson City, Tenn., and was meant to be delivered to United Nations Ammo Co., an ammunition shop in Phoenix, Mekenye said.

The store's owner said on Wednesday that the ammunition order had a value of $100,000.

Federal authorities still haven't announced whether they will charge Bogan with any crime. Ê

Mexican authorities have 48 hours to decide whether they will continue with an investigation.

However, federal officials said the decision would not be announced earlier than today.

Mexican federal prosecutors will press charges against the U.S. trucker who may have accidentally crossed into Juárez with 268,000 rounds of ammunition last week, a source familiar with the investigation said on Monday. The source, who requested not to be identified because he is not authorized to disclose the information, said Jabin Akeem Bogan, 27, will face charges for violation of provisions within Mexico's antigun laws.

The source said it was unclear under which provisions he would be charged, but it is possible he will be accused with possession of cartridges of exclusive use by the military.

His case will be resolved by the fifth district court in Juárez, where a federal judge has 72 hours to determine if Bogan will remain in prison until his next court date and what will happen with the seized rounds of ammunition.

Bogan is currently being held in a federal prison in Veracruz, Mexico, said his mother Aletha Smith. The source said Bogan will likely be transferred back to the federal prison in Juárez, near the Samalayuca desert.

Bogan was detained last Tuesday by Mexican federal customs officers at the Bridge of the Americas with the cargo. His employer and others have come out in his defense, saying the ammunitions were actually headed to Phoenix and that Bogan ended up in Mexico by accident.

US trucker arrested in Mexico with 268,000 bullets charged with smuggling military ammunition

By Associated Press, Updated: Thursday, April 26, 5:41 PM

EL PASO, Texas — The Mexican government has charged a U.S. truck driver caught with 268,000 rounds of ammunition at a border crossing in Ciudad Juarez with smuggling military ammunition, U.S. embassy officials in Mexico said Thursday.

Jabin Bogan, 27, of Dallas, is confined to the Villa Aldama federal prison in the state of Veracruz and could face up to 35 years in prison, the embassy said in a statement. Bogan was trying to drive the truck across the border from El Paso, Texas, when Mexican customs inspectors found the assault rifle ammunition, according to authorities.

Bogan’s boss, Dennis Mekenye, operations manager of Demco freight company, has said Bogan told him he took a wrong turn in El Paso and inadvertently crossed the border into Mexico.

Mexico prosecutors contend the cargo was ammunition that could be used in the assault rifles of choice of the drug cartels there.

Bogan’s mother, Aletha Smith, said Thursday that although she hasn’t been able to speak to her son, she knows he isn’t guilty. She said she would like to travel to Mexico to see him but that she doesn’t “know how that would work.

“I know there is a God, and as God is my witness, I know he knows my son is innocent and he will release my son,” Smith said.

Mekenye said Bogan informed him that after making two of his three stops in El Paso, Texas, he proceeded to drive to the third stop before heading to Phoenix, where the ammunition was to be delivered. But he took a wrong turn and found himself at the Bridge of The Americas, unable to make a U-Turn.

Both U.S. Border Patrol and U.S. Customs and Border Protection say they have no reports from officers that would indicate a truck driver stopped at the border bridge asking for directions on how to return to the highway.

“Had he told us it was not his intention to go to Mexico, we would have stopped traffic to allow him to initiate a U-turn and head north away from the port,” said Customs and Border Protection spokesman Roger Maier.

The ammunition was supposed to be delivered to United Nations Ammo in Arizona, and the owner has said the bullets were intended to be sold and used in the U.S.

Smith said El Paso based lawyer Carlos Spector has been hired to represent her son and that he will hire an attorney in Mexico. A call to Spector’s office was not immediately returned.

The embassy’s statement said embassy officials have visited with Bogan and are in contact with his family.
