9th Circuit Schedules DACA Termination Case for May

The 9th Circuit Court of Appeals accepted the Administration’s request for an expedited hearing on its appeal of a lower court ruling concerning the termination of DACA. A three-judge panel of the court will hear arguments in May.

On January 9th San Francisco-based District Judge William Alsup ruled the Administration must continue accepting DACA renewals. ​The Justice Department appealed his ruling to the Ninth Circuit and the Supreme Court simultaneously but, on February 23rd, the Supreme Court denied an appeal.

Yesterday,the 9th Circuit granted an expedited appeal, but denied a request for an expedited ruling.

The Court said the chosen panel of judges can decide whether or not to rule on an expedited basis.

In other litigation news, The Washington Times reports illegal-alien advocates filed three new lawsuitsThursday against the Department of Homeland Security.

One seeks to prohibit ICE from arresting illegal aliens at courthouses, while a second alleges that ICE is improperly detaining asylum-seekers while their cases are pending. The third suit seeks to reverse Homeland Security’s decision to terminate Temporary Protected Status (TPS) for about 50,000 Haitians.

The Administration is already the subject of dozens of lawsuits, including challenges to the Administration’s effort to crack down on sanctuary cities, the president’s travel ban, the border wall and the care of illegal aliens in detention.

So May, okay, then a decision in June, I'm sure to keep it, so then an appeal to the US Supreme Court which will likely take it into 2019 because by June the Supreme Court schedule is packed. UGH! (Should have let it expire on June 15, 2017 like the White House wanted to do.)

In the meantime...ramp up ICE efforts to arrest and deport every visa overstay and illegal alien they can

If I were an illegal or DACA...I would be saving my money...plan on selling out, pack up and go home to your country.

The Trump administration had no intention of shutting DACA down in June of 2017! I guess you're continuing that silly expiration date argument. There never was an actual expiration date, not in June of 2017 or at any other time prior to Sessions declaration that the program would officially end March 2018. Of course even that was not exactly true because hundreds of thousands of DACA illegals will continued to be protected until their individual authorizations expire.

Your lack of knowledge about implemented programs, the regulations and procedures that govern them, and the laws that govern contracts for money has led you down rabbit trail positions. There's nothing I can do about that. That is on you.

You're wrong and you know it. We've already had this discussion at length and you were repeatedly proven wrong in your ascertain that there was an actual expiration date. There was never an expiration date written into the program. All your obfuscations and feelings of superiority do not change actual facts.

You don't even know what an actual expiration date is. You don't need an expiration date written into the program. The expiration date is the end of the term or period of the program. It requires no level of superiority to know this.

Since it was an Executive order illegally instituted by Obama, and was not supported by Congress, as the law requires, it's expiration date was the date Obama left office.

President Trump SHOULD HAVE followed through with his campaign promise to end it on day one!

June 15, 2012 for 2 years, expires June 15, 2014

June 15, 2014, renewed for 3 years

June 15, 2017, actual expiration date, if not renewed.
