    ACLU sues Ariz. sheriff for immigration detentions

    PHOENIX — The American Civil Liberties Union is accusing Maricopa County Sheriff Joe Arpaio and his deputies of violating the constitution by arresting two men near a workplace immigration raid.

    A federal lawsuit filed Wednesday alleges that Julian and Julio Mora's truck was stopped as a result of racial profiling on Feb. 11. Deputies were raiding 66-year-old Julian Mora's employer when they arrested the two men and took them to the company's offices.

    The suit says Julian Mora is a legal U.S. resident and his 19-year-old son, Julio, is a citizen. Nevertheless, they were handcuffed for more than three hours as deputies questioned dozens of workers.
    The sheriff's office had no immediate comment.

    Arpaio's office has conducted numerous workplace raids in the past two years and made more than 250 arrests.

    Two Arizona residents filed a lawsuit Wednesday against the Maricopa County Sheriff's Office claiming the sheriff's deputies improperly detained the men during a worksite raid at a landscaping company earlier this year.

    The American Civil Liberties Union filed the suit in U.S. District Court on behalf of Julian and Julio Mora, who were both allegedly detained in handcuffs for more than three hours during the sheriff's February raid at H.M.I. Landscaping in southwest Phoenix.

    Julian Mora has lived in Arizona for more than 30 years and is a legal resident and his son, Julio, was born in the state, said Dan Pochoda, legal director for the Arizona ACLU.
    Both men were released after deputies determined they'd committed no crime.

    Attorneys for the men say the case should worry anyone in Sheriff Joe Arpaio's jurisdiction.

    "If it occurred to these folks, it could occur to anybody here in Maricopa County," Pochoda said.

    The lawsuit seeks an undetermined amount to compensate the men and punitive damages to prevent the same situation from occurring again, Pochoda said.

    Arpaio was not available immediately for comment, but in the past sheriffs officials have said it is the practice of deputies to detain many employees during worksite raids to uncover large-scale cases of identity theft and fraud.

    Julian and Julio Mora were arrested in a car approaching the landscaping company, about 100 yards from the business, according to the lawsuit.

    The suit is the first of its kind to emerge from one of Arpaio's efforts to enforce the Legal Arizona Workers Act through raids that round up identity theft and fraud suspects at local businesses.

    Sheriff's deputies have conducted nine such raids, arresting more than 250 workers, but no employers have been cited for violating the state law, which went into effect in January 2008.

    The ACLU also has a pending lawsuit in federal court that alleges sheriff's deputies racially profiled Hispanic motorists during the course of Arpaio's "crime-suppression operations."

    Another frivolous lawsuit by the ACLU. Doesn't AZ have tort reform? Also what happened to the doctrine of Sovereign Immunity? No doubt ACLU would raise that one if they were the ones in charge.
