Afghan Illegal Alien - Murderer Let Go Numerous Times Before
The case of Daryush Omar is so disturbing, so frustrating, that I'm still not sure who is going to get nominated for a free trip to Hell. It's a nightmare of impotent immigration policies combined with the revolving door of the American Justice system.
Omar, 24, of Queens, New York, is an illegal immigrant from Afghanistan. His mother snuck him into the United States when he was a baby, and the U.S. Has been trying to throw him out ever since. Check out the trials and travails of Daryush Omar and The United States Immigration Service.
* Omar came to the US illegally as a child, flying into JFK Airport with his mother on July 6, 1989.
* In 1992, an immigration judge denied his mother's asylum application and ordered Omar "excluded" from the United States.
* He was ordered out again in February 1994, but didn't leave.
* In October 2004, Omar was picked up by the Nassau County Police Department on an outstanding ICE warrant, and arrested the next day by federal agents.
* That same month, ICE officials made the first of several requests for travel documents from Afghan officials to deport Omar.
* On Nov. 30, 2004, Omar was taken into custody in Ocean County, NJ, on another outstanding warrant for driving while impaired and using offensive language. He was convicted Dec. 10 on the latter charge and returned to ICE custody.
* In September 2005, an immigration judge again ordered him deported; the order was finalized that October.
* In 2005, Omar allegedly renounced his Afghan citizenship in an effort to thwart deportation efforts.
* On Feb. 17, 2006, ICE - still without the paperwork to send him to Afghanistan - let Omar out on supervised release.
* From October 2006 through January 2008, ICE officials made a series of requests to Afghan officials, again requesting travel documents and asking the status of Omar's renunciation request.
* In February 2008, Afghan officials here told ICE they still hadn't made a decision of Omar's renunciation request.
During this period, Daryush Omar did not behave himself.
A 24-year-old Investment Banker, Thomas Whitney, asked Omar for directions on the morning of May 21, 2006; witnesses told police they saw the Omar bash Whitney's head with a steel bar and steal his wallet. He died hours later. Omar and two accomplices, Najib Noor, 19, and Walliullah Hashimi, 22, both of Queens, were later identified on surveillance footage using his credit cards - to buy gas, clothing and sneakers.
But although Daryush Omar and his friends were charged with Murder and Robbery, prosecutor have yet to try him, and he was released without bail soon after his arrest because none of the witnesses from that night have come forward in the two years since Whitney was beaten to death. Not one. They just haven't got enough evidence to try this guy, and no none who can really do anything about that apparently seems to care. Well, perhaps they'll care now.
At approximately 3AM on the morning of November 16th, 2008, Daryush Omar was driving his 2004 Range Rover at high speed southbound on 34th Street in Brooklyn when he ran a red light and slammed into a livery cab. The passenger in the cab, Panayiota Demetriou, 30, of Queens, and the driver, Bessy Velásquez, 41, of Brooklyn, were both severely injured.
Panayiota Demetriou had legally immigrated from Cyprus and was studying for graduate degree in child psychology at Pace University. Bessy Velásquez, a single mother of two teenaged girls, was working her second job driving for Myrtle Car Service - she also worked as a cleaner for Jet Blue Airlines at LaGuardia Airport.
Both women were pronounced dead a short while later at Mount Sinai Hospital of Queens.
Daryush Omar was drunk.
Omar has been charged with 2 counts of Vehicular Manslaughter, 2 counts of First Degree Criminally Negligent Homicide, 2 counts of Second Degree Criminally Negligent Homicide, Operating a Motor Vehicle While Intoxicated and several motor vehicle violations. Why was this guy on the street? With two previous DWI convictions, a murder indictment and a court order to deport him, why was he not sitting in a jail cell waiting for his walking papers. Even if they couldn't prosecute him for Thomas Whitney's murder, I don't understand why he couldn't be held in some kind of protective custody (for our protection) until Afghanistan was ready to take his ass back. And they're was always Guantanamo Bay - This guy was a much of a terrorist as anyone held there.
