    CASTLE ROCK (AP) - A man charged with murder in the gruesome death of his girlfriend admitted he had put a rope around her neck and dragged her behind a car for several miles, a state investigator testified Thursday.


    Jose Luis Rubi-Nava also wrote "Thank you. We are guilty" at the bottom of a statement, said Colorado Bureau of Investigation agent Larry Brown, who interviewed Rubi-Nava hours after the woman died. He testified that the "we" referred to another man who shared a home with Rubi-Nava and the victim.

    Rubi-Nava, 36, is charged with first-degree murder and second-degree kidnapping in the death of Luz Maria Francos Fierros, 49.

    Her mangled body was found on Sept. 18 in a quiet subdivision near Castle Rock, 20 miles south of Denver. An autopsy report said she died from strangulation and massive head wounds.

    Brown testified that during the videotaped interview, conducted in Spanish, Rubi-Nava said "he knew what he was doing was wrong and that he had repented what he had done."

    Other investigators testified the roommate was at work at the time the couple were quarreling before Franco-Fierros' death.

    Brown testified that Rubi-Nava told him the couple had a violent argument hours before Franco-Fierros' death, and Rubi-Nava accused her of seeing other men.

    Brady read an excerpt from Brown's interview report that said Franco-Fierros told the suspect, "You're worthless as a man. That's why I have other men."

    Thursday's preliminary hearing was to determine whether Rubi-Nava should stand trial. He was present in the courtroom but showed no emotion as he listened to testimony through an interpreter.

    Investigators have said Francos Fierros had been dragged behind a Saturn sedan by an orange cargo tie-down strap wrapped around her neck. Brown, recounting his Spanish-language interview with Rubi-Nava, referred to a rope.

    "He put it around her neck, he hooked it to her car, and he drove off," Brown said, recounting Rubi-Nava's statement.

    "He said she was still alive (when he began dragging her). ... He said he didn't stop until what he believed was three or four miles."

    Earlier Thursday, Douglas County sheriff's investigator Mike French said deputies found shredded clothing and bits of hair along a mile-long trail of blood leading to Franco Fierros' body.

    Both the suspect and the victim were from Mexico. Authorities have said Rubi-Nava was in the country illegally.

    French said a photo of Rubi-Nava found at the crime scene led to his arrest. After the photo was publicized, investigators received calls from a landscaper who said Rubi-Nava worked for him, and from another resident who said a family member had worked with Rubi-Nava at a McDonald's restaurant, French said.

    and isn't it nice he told investigators he repented for what he had done...
    Oh that is right I forgot he is illegal so it OK...he can do that...just like the man who pick axed his employer in Southern Cal the other day...and that one I don't think has made national news...either...

    And all of this horror and pain just to resolve a problem that we'd take care of with a breakup or a divorce lawyer, as the case might be.

    CASTLE ROCK, Colo. -- A hearing resumed Tuesday to determine whether a man accused of dragging his girlfriend to death behind a car is mentally retarded.

    Jose Luis Rubi-Nava 37, is charged with murder and kidnapping in the September 2006 death of Luz Maria Franco Fierros. Her mangled body was found early Sept. 18, 2006, in a quiet subdivision off Interstate 25, north of Castle Rock, 20 miles south of Denver. An autopsy report said she died from strangulation and massive head wounds.

    Investigators have said Rubi-Nava told them he had dragged her behind his car after a violent argument, when he accused her of seeing other men.

    Both were from Mexico and were living together in Glendale, Colo. Authorities said Rubi-Nava was in the country illegally.

    At a hearing in January, a state mental health doctor testified that Rubi-Nava is not mentally retarded, and said he has decent communication skills, follows instructions and can do simple math problems.

    But a defense psychologist has said Rubi-Nava is retarded.

    If Rubi-Nava is declared mentally retarded, it would prevent prosecutors from seeking the death penalty.

    I thought a murder committed after or during a kidnapping got an automatic death sentence? He deserves the death penalty for what he did!

    First of all anyone who does something like this cannot be considered human, IMO. Indeed, he does deserve the death penalty. But I bet he won't get it. He has REPENTED. In his Third World mind, he no doubt thinks no further punishment is necessary.
    Besides, MALDEF, La Raza, Lulac and the SPLC will be all over this one. They will provide him with the finest lawyer money can buy. He will say that his client acted the way he did because the gringo stole his land.
