Suspected illegal alien charged with child endangerment

An Albertville grandfather is in jail and faces Immigration and Customs Enforcement charges after his toddler grandson was found walking along a busy city roadway.

Workers at Bee Gee’s Restaurant, 1107 Baltimore Ave., discovered a 3-year-old toddler walking along First Street, wearing only a diaper.

Gaye Rains, a co-owner of the restaurant, had reportedly left the restaurant to make a delivery when she spotted the child in the roadway. She took the child to the restaurant while the police were called.

According to Assistant Police Chief Maj. Jamie Smith, officers searched for the child’s parents or a guardian with no success and after about 45 minutes called the Department of Human Resources to take custody of the child.

During the process, Salvador Gutierrez, the child’s grandfather, was located in a nearby mobile home park asleep in one of the homes.

Gutierrez told officers on scene he was watching the child for his son, who was reportedly at work at Pilgrim’s Pride. However, when officers called Pilgrim’s Pride, plant officials said no one with the name provided worked there.

Gutierrez was charged with endangering the welfare of a child and transported to the Albertville City Jail, where he remains under an ICE detainer pending further investigation.

The child remains in DHR custody.
