    MONTGOMERY, Ala. (AP) — The Alabama Legislature passed an Arizona-style law Thursday night to crack down on illegal immigration, including a requirement that all businesses verify new employees are legal residents.

    The House voted 67-29 and the Senate concurred 25-7 in a compromise bill worked out by two Republican legislators who led the charge for the legislation, Rep. Micky Hammon of Decatur and Sen. Scott Beason of Gardendale. The bill now goes to Gov. Robert Bentley, who has advocated immigration legislation.

    "This is an Arizona bill with an Alabama twist," Hammon said.

    Like the Arizona law, the Alabama bill allows a police officer who stops a motorist for a traffic violation to detain the person if he has a "reasonable suspicion" the person is in the country illegally. The sponsors said that if the motorist doesn't have a driver's license or other document to show, the police officer will have to try to determine the identity by checking other records. They said "reasonable suspicion" could include acting nervously or having a tag that doesn't match vehicle registration records.

    Democratic Sen. Linda Coleman of Birmingham predicted it would lead to discrimination. But Beason said, "You can't just stop someone because of how they look."

    The bill requires businesses to use the federal E-Verify system to check to see if their new hires are legal residents. Businesses with 25 or fewer employees could use the state Department of Homeland Security to do the checks for them.

    Any business twice cited for hiring illegal workers could lose its business license.

    Beason said the checks would get rid of illegal workers that are taking jobs that should go to legal Alabama residents.

    "This is a jobs bill," he said.

    The bill also makes it a crime for an illegal immigrant to apply for a job and for anyone to transport or harbor illegal immigrants. It prevents cities from passing laws to protect illegal immigrants in their cities.

    Alabama has passed a sweeping bill to crack down on illegal immigrants that both supporters and opponents call the toughest of its kind in the country, going well beyond a law Arizona passed last year that caused a furor there.

    The measure was passed by large margins in the Alabama Senate and the House, both Republican-controlled, in votes on Thursday. Governor Robert Bentley, a Republican, is expected to sign the bill into law.

    Its great news and another state that clearly shows their willing to take action against the invasion of this country by unpatriotic, illegals who feel the stars and stripes should be replaced by the mexican rag.

    Alabama Passes Mandatory E-Verify & Immigration Enforcement Bill

    An Alabama House and Senate conference committee agreed on a new bill, which both chambers have already passed, that requires the use of E-Verify by all businesses in the state and includes several immigration enforcement provisions. Should Gov. Robert Bentley sign the bill into law, it would become one of the largest state crackdowns on illegal immigration in the country.

    The bill requires all businesses, public and private, to begin using E-Verify effective April 1, 2012. Businesses that do not comply face suspension of its business license and loss of employee expensing for state income tax purposes. All state and local businesses must be in compliance by Jan. 1, 2012 or face loss of business license and contract.

    The bill calls for assisting small business compliance with the E-Verify requirement by establishing an E-Verify designated agent that can check new hires on the behalf of businesses that employ fewer than 25 employees.

    Other provisions within the bill include:

    • Creates an affirmative defense against business penalties if E-Verify is used. Prohibits lawsuits against businesses that fire an employee due to an E-Verify final non-confirmation determination;

    •Require state and local governments to use the SAVE system to verify public-benefits eligibility for those attesting to be non-citizens;

    • Creates a misdemeanor for failure to carry an alien registration document;

    • Requires police, after a lawful stop and when practicable, to check a person’s immigration status if the officer has a reasonable suspicion that the person is illegally present. Provides 4th amendment protections and stays the status-check requirement for persons who are crime victims or witnesses;

    • Creates misdemeanors for seeking day-laborer work when illegal present and hiring illegally-present day laborers. Creates misdemeanors for aiding and abetting illegal aliens; Ban illegal aliens from state universities and colleges;

    • Prohibits sanctuary policies and provides non-compliance penalties;

    • Requires the Attorney General to apply for a 287(g) MOU for state police;

    • Creates a crime for producing fake IDs; and

    • Requires elementary and secondary schools to request a birth certificate for all enrolling students and to determine whether such children were born outside of the U.S. or are children of illegal aliens requiring English-as-a-Second-language classes. Requires the collection of statistics and a determination of the costs related to illegal-alien students.

    The governor of Alabama is taking the weekend to decide whether he will sign an Arizona-style bill into law to crack down on illegal immigrants.

    If Gov. Robert Bentley gives his stamp of approval to the controversial legislation, the American Civil Liberties Union has vowed to challenge it in court.

    "It's an outrageous throwback to the pre-civil rights era and we call on Governor Bentley to veto this deeply misguided bill," Cecillia Wang, director of the ACLU Immigrants' Rights Project, said Friday. "The Alabama Legislature has invited rank discrimination into people's everyday lives,"

    The bill, passed by the Alabama Legislature on Thursday night, makes it a crime for a person to be in the state without a valid federal registration or other proof of legal presence.

    Like the Arizona law, the bill allows police in a traffic stop to detain anyone without legal papers if the officers have "reasonable suspicion" that they may be present illegally and research by the officers can't turn up any records. "Reasonable suspicion" could include acting nervously or having a tag that doesn't match vehicle registration records, sponsors of the bill said.

    It would also be a crime for an illegal immigrant to apply for work. The bill requires all Alabama businesses to use the federal E-Verify system to check the legal status of new employees, although businesses with 25 or fewer employees could get the state Department of Homeland Security to do it for them. A business caught twice for knowingly hiring an illegal immigrant would lose its business license.

    The bill also makes it a crime to transport or harbor illegal immigrants and it prevents cities from passing laws to protect illegal immigrants in their cities.

    The bill sailed through the Legislature on votes of 67-29 in the House and 25-7 in the Senate.

    Support came from Republicans and some white Democrats, while black Democrats led the opposition.

    "This is an Arizona bill with an Alabama twist," said the sponsor, House Republican leader Micky Hammon.

    Republican Sen. Scott Beason, who helped write the legislation, said it's designed to take jobs away from illegal immigrants and give them to legal residents. "This is a jobs bill," he said.

    Democratic Sen. Linda Coleman predicted it would lead to discrimination. But Beason said, "You can't just stop someone because of how they look."

    Bentley's communications director, Rebekak Mason, said he will spend the weekend reviewing the long, complicated bill before deciding what action to take, but "having a strong illegal immigration bill has been a top priority for the governor."

    He'll need to wait another eight or ten years when he has enough illegal aliens to either reelect him, or someone else.

    Of course by then, it won't matter. Alabama won't be a state by then at this rate.

    For right now governor, you may just be forced to side with the US Constitution and uphold your oath to protect the good citizens of America against foreign invasion.
