    Freeway rapist gets 24 years

    Stories from a year ago identify him as having an immigration hold (see foxla link below today's story). Not surprisingly, today's report doesn't identify his immigration status, but at least he's off the streets for now. He tried to call her 20 times in the days following? Did he think this was some kind of courtship?

    A San Juan Capistrano man who raped a woman after she became stranded on the side of the I-5 freeway was sentenced to 24 years in prison today.

    After Alejandro Martinez Leyva, 26, raped a 24-year-old San Diego woman, he then called her more than 20 times on her cell phone the following two days, authorities said. Investigators were able to link Leyva to the crime through DNA and a palm print he left on the window of the car.

    Leyva was sentenced in court today after he pleaded guilty to one felony count of forcible rape, two felony counts of sexual penetration by foreign object by force, one felony count of assault with the intent to commit a sexual offense, one felony count of dissuading a witness, and a sentencing enhancement for kidnapping to commit a sexual offense.

    The rape occurred at about 1:30 a.m. Dec. 8, 2007, when the victim became stranded near the Junipero Serra Road exit. While she was driving to San Diego, she hit the center divider when she swerved to avoid another car on the freeway. The victim tried to call a friend from her cell phone, but Leyva pulled up his car in front of her vehicle.

    Authorities said Leyva was driving a dark green or blue older sedan with a trunk spoiler and a baby seat in the back. As he walked toward her, the victim got into her car. Leyva knocked and then grabbed her cell phone from her hand, tossing it in the back of the car.

    Investigators said Leyva struggled with her as she tried to call 911. He again grabbed the phone and threw it out the window.

    The woman began to run away, but tripped on the road. Leyva took her back to the car where he raped her on the freeway shoulder.

    Leyva was taken into custody three days later at his San Juan Capistrano home, where deputies found his car.

    Freeway Rape Suspect

    A man who allegedly raped a 24-year-old woman whose car broke down on a San Diego freeway was expected to enter a plea today to six felony charges, prosecutors said.

    Alejandro Martinez Leyva, 25, is charged with forcible rape, two counts of sexual penetration, sexual assault with the intent to commit rape, dissuading a witness and making a criminal threat.

    He faces up to 23 years in prison if convicted, said Farrah Emami of the Orange County District Attorney's Office.

    The alleged victim was driving south on the San Diego (5) Freeway toward her home in San Diego County about 2:30 a.m. Saturday when her car spun out near the Junipero Serra Road off-ramp and became disabled.

    Leyva allegedly stopped in front of her vehicle and offered assistance, then sexually assaulted her, according to authorities.

    Semen found at the scene has been linked to Leyva, and the alleged victim has identified him from a photo, said sheriff's spokesman Jim Amormino.

    Leyva was arrested late Tuesday night at his San Juan Capistrano home, which is near the crime scene, Amormino said.

    Leyva, a gardener and apparent illegal immigrant, was being held at the Orange County Jail, and an immigration hold was placed on him, Amormino said.

    The woman's car became disabled after she swerved to avoid another vehicle and hit the shoulder barrier. She used her cell phone to contact a friend and had gotten back inside her vehicle when Leyva approached and knocked on the window, Emami said.

    He grabbed her cell phone, threw it in the back of the car and attacked her, Emami said.

    The woman broke free and began to run away, but tripped in front of the car. Leyva allegedly grabbed her and threatened to push her down a nearby embankment if she did not cooperate, Emami said.

    Leyva is accused of digitally penetrating her, then pushing her back into the car and trying to pull down her pants. He allegedly digitally penetrated her again before raping her, Emami said.

    Leyva is charged with dissuading a witness for allegedly grabbing the cell phone at the beginning of the attack and throwing it out of reach, Emami said.

    A judge may set bail on the rape case, but Leyva will not be released because of the immigration hold, Emami said.
