Amid immigration debate, DEMS battle GOP over 14th Amendment
Amid immigration debate, Democrats battle GOP over Fourteenth Amendment
The Hill
By J. Taylor Rushing
Senate Democrats pushed back Tuesday against Republican demands to change a part of the 14th Amendment that grants U.S. citizenship by birthright to children of illegal immigrants.
Senate GOP leader Mitch McConnell (Ky.) and GOP Whip Jon Kyl (Ariz.) have called for hearings on the amendment, while Sen. Lindsey Graham (R-S.C.) has called for elimination of the provision.
The arguing is over the Citizenship Clause to the 14th Amendment, which was adopted in 1868 during the Reconstruction era. The clause was intended to reverse the 1857 Supreme Court decision in the Dred Scott case that denied citizenship to African-Americans. The Supreme Court subsequently interpreted the clause to mean that children born in the United States have an inherent right to citizenship.
Republicans maintained Tuesday that modern times present a much more difficult situation, with immigration stressing the country’s resources and dividing the country.
“I’m supportive of [changing the provision] because at the time the amendment was put in, transportation was different, the environment was different and we didn’t have as much crime,â€Join our FIGHT AGAINST illegal immigration & to secure US borders by joining our E-mail Alerts at http://eepurl.com/cktGTn

Sen. Tom Harkin (D-Iowa) said a change would introduce a dangerous precedent of tying citizenship to political beliefs.

Feingold nixes GOP request for hearings into 14th amendment
Republicans may be calling for hearings into revising the 14th amendment, which guarantees citizenship to children of illegal immigrants, but it looks like they're not going to get 'em.
Russ Feingold, who chairs the Constitution Subcommittee, which would conduct the hearings, has "no plans" to allow them to go forward, his spokesman confirms to me.

Justice Brennan's footnote gave us anchor babies
Justice Brennan's footnote gave us anchor babies
The drafters of the 14th amendment had no intention of conferring citizenship on the children of aliens who happened to be born in the U.S.
And then, out of the blue in 1982, Justice Brennan slipped a footnote into his 5-4 opinion in Plyler v.
Brennan's authority for this lunatic statement was that it appeared in a 1912 book written by Clement L. Bouve. (Yes, the Clement L. Bouve -- the one you've heard so much about over the years.) Bouve was not a senator, not an elected official, certainly not a judge -- just some guy who wrote a book.
So on one hand we have the history, the objective, the author's intent and 100 years of history of the 14th Amendment, which says that the 14th Amendment does not confer citizenship on children born to illegal immigrants.

Birthright Citizenship: Moving the GOP Immigration Goalposts
Birthright Citizenship: Moving the GOP Immigration Goalposts
[quote]Five years ago, Arizona’s senators – John McCain and Jon Kyl – were two of the biggest supporters of the George W. Bush amnesty.
In the Senate, we were offered a choice between the McCain/Kennedy amnesty and the Kyl/Cornyn amnesty. At the time, the latter was advertised as a “compromise bill,â€Join our FIGHT AGAINST illegal immigration & to secure US borders by joining our E-mail Alerts at http://eepurl.com/cktGTn

14TH Amendment
I realize both Dems and Repubs have fiddle farted around and caused the immigration fiascos we have in this country, but, the Dems are continuing to forge ahead with these totally outdated ridiculous notions of "babies" of anybody and everybody standing for 10 seconds on U.S. soil that plops a kid out is a citizen! IF, and it is a bif IF, anybody that proclaims they are against illegal immigration and too high legal immigration I am for voting for them...Dem or Repub makes no difference. The amendment itself doesn't need to be changed, if that makes the morons such as the broad from Maryland happy, but a DEFINITE CLARIFICATION for the dense needs to be officially "passed" or something. Personally for me REPEAL/ABOLISH the entire thing would be fine....and yeah we have had this hogwash our entire lives because some silver tongued lawyer or politician hood winked the public that was sleeping. Then NO ONE bothered to question it.....I never ever thought the interpretation was correct AT ALL, but no one ever listened to me...and to the senator that said it would be "debasing"(is that right) our citizenship, what a load of BS....debasing, cheapening our citizenship is giving it to every person that raises their hand and says....I would like citizenship please and you fools GIVE it to them, no questions asked!!

Arizona’s tough immigration law is just the beginning of the conservative battle to clamp down on illegal immigrants. A broader fight is coming—possibly even to change the U.S. Constitution.
Sen. Lindsey Graham made headlines last week, telling Fox News he’s considering a constitutional change to revise the right, enshrined in the 14th Amendment, that grants automatic citizenship to any child born in the United States. He would revoke this right for children of illegal immigrants.
