    Sounds fair, they did there best to follow the law. Work hard, pay taxes
    keep out of trouble. A bad lawyer took advantage of them (giving the 1%
    of good lawyers a bad name). It will probably take years to pay off the legal fees. I hope the kids get back on track we need Legal Immigrants.

    However, they claimed they were never informed of the situation by their attorney at the time. That attorney has since been reprimanded for this shoddy handling of the case.
    Notice however, that their argument before the court was not the incompetent representation they received from their attorney. It was in fact the "hardship" that would be placed on their children (American Citizens) if they were to be deported.

    This sets a dangerous precedent for the millions and millions of illegals we have in this country and their anchors which could potentially protect them form deportation if similiar judicial reasoning were to be adopted.

    He'll probably use this "ordeal" as a sob story entrance essay. And I'm sure the Ivy League admissions personnel will just love it. Isn't the U.S. a great country.

    I'm certain he will take the "position" of a United States Citizen. The United States is not going to last much longer! Third World here we come, a special thanks to "our" last three Presidents and "their" congress and as it looks now "our" next President.

    I tend to agree with your assessment jimpasz.

    With all of the garbage and antics we're exposed to coming from the majority of illegal aliens and their advocates, it's easy to forget that not everyone of illegal status is cut from that same bolt of cloth.

    There are many who came here legally, did all of the right things, been productive, law abiding members of society and fully intended to live their lives here as American citizens only to, through no fault of their own, find themselves falling out of legal status and ending up with a legitimate legal nightmare on their hands trying to get it all sorted out.

    It's just too bad that all of these so called "immigrant advocates" and lawyers looking to make big names and money for themselves don't exert their time, energy, and resources toward helping those with legitimate immigration issues and making sure those who would take advantage of them are not only put out of business but put in jail where they belong.

    It's questionable as to whether these people did the "right" things from the very beginning. You need to read into the sob story being presented here.

    First:

    The court’s Portuguese translator, herself in tears, offered tissues to about a dozen people who were there to support the family.
    They have been here some 20 years and they still requested a translator. So much for assimilation.

    Next:

    Their problems began in the mid-1990s, when they were allegedly duped by a man who sold them fraudulent work documents, then fled the U.S. The couple did know they were scammed until years later.
    I was not aware the United States had independent contractors who were authorized to sell immigration documents. Apparently these people did not either. In addition, i'm sure they used those "fradulent" documents to secure drivers licenses, work and probably many other privileges that are reserved for legal citizens. Ignorance is usually not a valid defense in such cases.

    Further:

    Pereira and Lima, who are not married but have lived together for 18 years, were ordered out of the country in 2002 and 2004, respectively.

    However, they claimed they were never informed of the situation by their attorney at the time. That attorney has since been reprimanded for this shoddy handling of the case.
    They finally hired an attorney when they received deportation orders in 2004 and that attorney did not handle the case properly. That was wrong and the attorney was admonished for his role.

    However, they were already issued orders of deportation at that point. There was little this attorney could have done at that point to allow them to remain in the US. The goverment already considered their arguments they were sold fradulent documents some years back. That was obvioulsy not compelling enough to stay the order of deportation.

    Again, their arguemment in court was their American Citizen Children would suffer undue hardship if the parents were deported back to Brazil. The argument was not they were taken advantage of many years earlier, or the lawyer they hired to handle the deportation order was incompetent.

    Once again, this whole matter sounds as if these people want everyone to perceive them as innocent victims. Bad attorney, fake documents, American Children suffering without their parents.

    Sounds too familiar to me. They just found a judge who bought into it.

    I found it odd to require a translator after all this time....yet say it would be a hardship for the boy to test in Brazil because he couldn't speak Portugese. How did they communicate all these years?
