    Are they waiting for the public to forget this murder of an American child before telling us?

    If he is an illegal alien, even if it takes a month to tell us, I will not forget
    and will do my best to inform others.

    Another article on this story was in my local paper (the Raleigh N&O) today. According to the article, Hipolito's immigration status is still in question.

    To me, that makes it pretty obvious that he IS illegal. I'm wondering if we will have his status confirmed. It's the same thing with the Campbell University professor.

    Maybe he left his papers at home. They should let him go get them if he promises to come back.

    Its been common the last 6 months or so for them to question the immigration status, then you never see a follow up with the real status..

    I am surprised the media has given up on the tack that he is just another poor soul consumed by alcoholism. Chicken-man obviously has a problem with alcohol.

    JOHNSTON COUNTY -- New charges have been filed against the driver police say is responsible for a 7-year-old's death.

    Hipolito Hernandez, 30, is charged with the murder of a 7-year-old Johnston County boy.
    Eyewitness News has also learned that the man who first gave authorities a fake name has been charged with drunken driving four times.

    The N.C. Highway Patrol added the second-degree murder charge Thursday.
    Hernandez appear before a judge again on April 24 to face the murder charge.
    The suspect had a blood alcohol level more than twice the legal limit when he lost control of his car Sunday, hitting and killing 7-year-old Marcus Lassiter.
    Investigators say Hernandez was traveling about 70 mph shortly before the crash. That's 25 mph above the posted speed limit. And his arrest isn't the first run-in with the law.
    He was arrested for driving drunk three times before -- one from 2007 is still pending and the other two charges were dropped when the officer didn't show up in court.
    Johnston County Sheriff's officials and Highway Patrol troopers vow to get Hernandez off the streets and if he's in the country illegally, get him out of the states.Officials are getting help from ICE. Federal immigration officers have flagged Hernandez as a likely illegal immigrant.After he faces state and local charges, a judge will decide if there is enough evidence to have him removed from the country.

    You know, I'm glad the police are making a vow to get this scumbag POS off the streets and deported if he's found to be here illegally. But WHY is it that it's all too little and too late- A seven year old precious little boy is dead because of this filthy, selfish bastard who had no business behind the wheel of a vehicle to begin with- legal or illegal. TWO charges dismissed because a cop fails to show up for court. UNACCEPTABLE! I guess nobody EVER THOUGHT to check this dirtbag's immigration status all the other times he was caught breaking a law and needing an interpreter to communicate. INTOLERABLE!

    What in the heck are they talking about?

    They guy needs to spend years behinds bars, not be deported. I realize the cost of prison will fall on us. However, I cannot in good conscience support deporting him, not until he's attoned for his crimes. Deportation is not a punishment for murder! Actually, deportation is not a punishment at all, not unless you're a legal immigrant.

    He is accused of DWI, killing boy

    SMITHFIELD - A drunken-driving suspect charged Thursday with second-degree murder after a 7-year-old boy was struck and killed had been wanted by police since December for failing to show up in court to answer a previous drunken-driving charge, according to prosecutors.

    Hipolito Camora Hernandez, 30, of Parkertown Road in Four Oaks is now in the Johnston County jail on a host of charges related to the death of Marcus Lassiter, who was struck near Four Oaks on Sunday and died at Duke Hospital the next night.

    An order for Hernandez's arrest was issued in December when he failed to show up for court, but he eluded arrest until this week.

    Authorities think Hernandez is in the country illegally. On Wednesday, U.S. Immigration and Customs Enforcement placed a detainer on him, meaning that if convicted, he will likely face deportation after he completes his sentence, said Tom O'Connell, resident agent in charge of the agency's local office.

    Hernandez has been charged with drunken driving at least four times before but has never been convicted, according to court records. The December court date he missed stems from a pending drunken-driving charge from March 2007.

    Two other DWI cases -- in 2004 and 2005 -- were dismissed. On Thursday, a Johnston County prosecutor said the state was unable to try the cases because prosecuting witnesses did not show up for court.

    "The law officers in both cases were out of place," said Paul Jackson, a Johnston County assistant district attorney.

    Johnston County court records indicate that just before midnight on Aug. 4, 2004, a Four Oaks police officer stopped Hernandez on U.S. 301 South and charged him with driving while impaired and driving left of center. His blood alcohol content at the time of his arrest was 0.22, more than twice the legal limit of 0.08, the traffic citation shows. On Jan. 7, 2005, the charges were dismissed because the investigating officer was not in court.

    Six months later, on the night of Feb. 6, 2005, a Smithfield patrol officer charged Hernandez with speeding and driving while impaired. Hernandez again had a blood alcohol content of 0.22, court records show. The charges were dismissed nine months later when the police officer failed to show for court, records show.

    In a 2006 DWI case, Hernandez was convicted of reckless driving to endanger, for which he paid a $25 interpreter's fee and $210 in court costs and fines, court records show.

    Jackson said he was not sure why Hernandez was allowed to plead to a lesser offense for the 2006 DWI charge. But, Jackson said, speaking in general terms, allowing a defendant to plead to a lesser charge suggests prosecutors could not prove the case beyond a reasonable doubt.

    In 2006, Johnston County had the lowest conviction rate for drunken-driving cases among Triangle counties; prosecutors dismissed 45 percent of all impaired-driving charges in Johnston that year, compared with 14 percent dismissed statewide, according to an analysis of data from the state Administrative Office of the Courts.

    Jackson said he does not think the statistics tell the entire story of how DWI cases are tried in the county. He pointed to a variety of factors that could lead to a dismissal of DWI charges, including absent witnesses and a judge's denial of a prosecutor's request to delay a case before it goes to trial.

    "If I can emphasize, DWI cases are the highest priority in District Court," Jackson said. "It's important because drunk drivers pose an obvious danger to everyone in the community. We are committed to prosecuting those cases."

    This week, the Highway Patrol originally charged Hernandez with felony hit and run, felony assault, DWI, possession of a stolen vehicle, driving without a license, speeding and reckless driving.

    Marcus was standing on the side of the road when a car went out of control on a curve, ran onto the shoulder and struck him, a witness told investigators. The car was going 70 mph, or 25 mph above the speed limit, the patrol said.

    Susan Doyle is also the DA for Lee County where Pastor Sanchez murdered three kids in Oct 2006 while driving drunk, without a license.

    The Asst DA (don't remember his name) accepted a plea of 3 cts involuntary manslaughter (48-60 months with credit for time served equals a year per victim).

    For Paul Jackson to say they accept pleas because they can't prove cases beyond a reasonable doubt is a lie. They had three dead bodies; what more did they need!

    Okay, now I feel better. The article posted yesterday led me to believe there was a possibility he would be deported prior to serving time for his crimes. I didn't think such a thing was possible, however, you never know these days.

    Four Oaks, N.C. — The suspect in a hit-and-run accident that killed a Johnston County boy Sunday was in the country illegally, immigration officials confirmed Friday.

    Hipolito Hernandez, 30, listed a local address of Parkertown Road in Four Oaks.

    He is charged with second-degree murder, felony hit-and-run, felony assault, driving while intoxicated, possession of a stolen vehicle, driving without a license, speeding and reckless driving in the death of the child.

    Immigration and Customs Enforcement spokesman Richard Rocha said Friday that Hernandez would be remanded to ICE custody after his state charges are settled.

    State troopers said Marcus Lassiter, 7, had been playing in his grandmother's front yard and was trying to cross Heath Road when a car driven by Hernandez struck him.

    The child’s leg was broken, and he had brain damage. His family decided to remove him from life support, and he died Monday night.

    has this tragic story had any national coverage?

    now that its official thet the driver is an illegal immigrant I think it is time to spread the word to the mass media.

    Notice how the local media refers to this illegal alien child killing drunk
    with no license, insurance,and a stolen car as "in the country illegally"
    The local DA and Judges want to bury this.
