Carlos David Rodriguez-Bautista, 34, was arrested Friday morning.
An officer on patrol Thursday night saw a 2003 Chevrolet Express van with damage to its front "that was consistent with a pedestrian collision".
The suspect has been charged with felony hit and run and was placed in the Wake County Jail under an $8,000 bond.

Carlos David Rodriguez-Bautista, 34, is charged with felony hit and run in the accident that killed a Raleigh man.

On Friday, Judge Ned Mangum increased Rodriguez-Bautista's bond from $8,000 to $25,000 stating that he had failed to appear for another court date.

An immigration detainer is also holding him in custody by the Federal Government claiming he is in the United States Illegally.

According to Mangum, the felony hit and run charge is punishable by up to 44 months in prison.

The hit and run happened on Wednesday morning on Falls of Neuse Road around 7 a.m. Rodriguez-Bautista's vehicle was the first car out of four to hit Lewis Gray as he was walking across Falls of Neuse Road.

Raleigh Police Officer M.J. Corso arrested Rodriguez-Bautista on Thursday while on patrol in the 7200 block of Woodbend Drive.

Even though witnesses described an SUV as the vehicle, Corso noticed a 2003 Chevrolet Express van with damage to the front.

"Witness statements differ from time to time they contradict each other from time to time, this is a perfect example of him looking a little bit beyond that and finding a vehicle that had damage that was consistent with a pedestrian accident," said Raleigh Capt. R.J. Daigle.

Rodriguez-Bautista's next court date is April 2, 2009 at 2 p.m.

Police said more charges are possible. Police said the driver's of the third and fourth vehicles to hit the victim did not leave the area and will not be charged.
