    NC - Officers Arrest Man Involved In Fatal Hit-And-Run

    Carlos David Rodriguez-Bautista, 34, was arrested Friday morning.
    An officer on patrol Thursday night saw a 2003 Chevrolet Express van with damage to its front "that was consistent with a pedestrian collision".
    The suspect has been charged with felony hit and run and was placed in the Wake County Jail under an $8,000 bond.

    Carlos David Rodriguez-Bautista, 34, is charged with felony hit and run in the accident that killed a Raleigh man.

    On Friday, Judge Ned Mangum increased Rodriguez-Bautista's bond from $8,000 to $25,000 stating that he had failed to appear for another court date.

    An immigration detainer is also holding him in custody by the Federal Government claiming he is in the United States Illegally.

    According to Mangum, the felony hit and run charge is punishable by up to 44 months in prison.

    The hit and run happened on Wednesday morning on Falls of Neuse Road around 7 a.m. Rodriguez-Bautista's vehicle was the first car out of four to hit Lewis Gray as he was walking across Falls of Neuse Road.

    Raleigh Police Officer M.J. Corso arrested Rodriguez-Bautista on Thursday while on patrol in the 7200 block of Woodbend Drive.

    Even though witnesses described an SUV as the vehicle, Corso noticed a 2003 Chevrolet Express van with damage to the front.

    "Witness statements differ from time to time they contradict each other from time to time, this is a perfect example of him looking a little bit beyond that and finding a vehicle that had damage that was consistent with a pedestrian accident," said Raleigh Capt. R.J. Daigle.

    Rodriguez-Bautista's next court date is April 2, 2009 at 2 p.m.

    Police said more charges are possible. Police said the driver's of the third and fourth vehicles to hit the victim did not leave the area and will not be charged.

    RALEIGH -- A man arrested early today in a hit-and-run fatality has failed three times to show up in court on prior charges, a judge said today.

    Wake District Court Judge Ned Mangum hiked bail for Carlos David Rodriguez-Bautista, 34, from $8,000 to $25,000 after finding that he has three pending charges of failure to appear in Onslow and Alamance counties.

    Rodriguez-Bautista also was charged in 2006 with driving while impaired in Raleigh, though Mangum said he did not know the disposition of that case.


    Federal immigration authorities have placed a detainer on Rodriguez-Bautista, a native of Honduras, who may be in the country illegally.

    Rodriguez-Bautista was arrested early this morning on a felony charge of hit and run in the death Wednesday morning of a pedestrian on Falls of Neuse Road. If convicted, he faces a maximum 44 months in prison.

    Police think Rodriguez-Bautista was the first driver to strike Lewis Avery Gray, 71, as he crossed Falls of Neuse near Spring Forest Road early Wednesday. Three other vehicles subsequently struck Gray, who lived nearby and was not in a crosswalk at the time, police said.

    Witnesses told investigators that the first driver stopped and briefly got out of what they thought was a Chevrolet sport utility vehicle, then drove away.

    Police officer M.J. Corso spotted a 2003 Chevrolet Express van with damage to its front about 11:30 p.m. Thursday in the 7200 block of Woodbend Drive. Officers then linked the vehicle to Rodriguez-Bautista, whose address was not immediately available.

    A second driver was charged Thursday with misdemeanor hit and run. Police said that driver, Carlos Humberto Agustindiaz, was behind the wheel of a landscaping truck that also struck Gray and left the scene of the accident.

    Two other drivers who struck Gray remained at the scene and were not charged.

    Sounds like there is an excellent possibility that Carlos Humberto Agustindiaz is an illegal alien too. What other reason could he have had for leaving the scene of an accident that he didn't cause? Okay, I'll admit, there could be other reasons, however, I think immigration status would be the #1 reason. I hope federal investigators are checking on his status (no mention of it in the story). Furthermore, if he is an illegal, the employer should be held accountable for hiring him.

    Unrelated question: In America, what are the odds of someone being hit by two Carlos' in succession?

    What are the odds indeed!!

    In one of the articles on another illegal alien hit and run a week ago, it was pointed out that in North Carolina, they don't run immigration checks on someone unless they're charged with a felony. The second Carlos in this hit and run case was charged with misdemeanor hit and run whereas the first Carlos was charged with felony hit and run which is why the Raleigh police ran an immigration check on him and not the other one.

    It should be law in the United States that local and state law enforcement of any non-citizen involved in any crime or violation, misdemeanor or otherwise should be run through immigration to verify their status. It's just common sense.
