    I heard a discussion the other day that said that the 9th Circuit is a mixed bag, that while leaning left with the majority of their Judges, it does have some moderate and conservative Judges, and with the 3 Judge or 1 Judge issue, you can luck out and get a moderate or conservative to decide your issue. Maybe that's what happened here. Article says it was a 3 Judge Panel and maybe 2 were moderates/conservatives. Or maybe sometimes, the liberals get it right!!
