    Ariz. governor files brief in immigration battle

    PHOENIX — Gov. Jan Brewer's lawyers have filed the first brief in their appeal of a ruling that put the most controversial elements of Arizona's new immigration law on hold.

    Brewer on Thursday asked the 9th U.S. Circuit Court of Appeals in San Francisco to reverse the ruling U.S. District Judge Susan Bolton made last month.

    The governor's lawyers say the federal government hasn't effectively enforced immigration law at the border and in the state's interior and that the state's intent in passing the law was to assist federal authorities, as Congress has encouraged.

    They also say Bolton erred by accepting the federal government's speculation that the law might burden legal immigrants.

    Calls to the Justice Department, which went to court to invalidate the law, weren't immediately returned Thursday.

    PHOENIX (AP) — Gov. Jan Brewer's lawyers on Thursday plan to file the first brief in their appeal of a ruling that put the most controversial elements of Arizona's new immigration law on hold.

    Brewer wants the 9th U.S. Circuit Court of Appeals in San Francisco to reverse the ruling U.S. District Judge Susan Bolton made last month.

    The governor's office says Bolton abused her discretion by applying the wrong legal standards and basing her ruling on the federal government's speculation that it would be harmed by Arizona's law. Brewer says the judge ignored key provisions of federal law that allow states to enforce immigration law.

    The U.S. Justice Department went to court in a bid to invalidate the law.

    The Justice Department had no immediate comment Thursday.

    The governor faces a Thursday deadline for filing the brief but hadn't done so by early afternoon.

    Bolton blocked provisions of the law that requires immigrants to obtain or carry immigration registration papers and that require police, while enforcing other laws, to question people's immigration status if there is a reasonable suspicion they're in the country illegally.

    But the judge let other portions take effect late last month, such a ban on blocking traffic when people seek or offer day-labor services on streets, and amendments to existing state immigration laws.

    I hope Arizona wins their appeal so they can get busy full force enforcing US immigration law in their state as well as other states doing likewise. It's such a serious problem for us all, that I hope the courts see that and don't pander to non-existent threats to civil liberties, especially when they've overlooked so many real ones over the years and still are to this day.

    Nice thoughts, Judy, but the 9th will favor on the side of the feds. I have no faith in this court to do the right thing.

    I'm not so sure about that since it's my understanding that the state of Arizona was won every one of their cases that were appealed to the 9th Circuit on other immigration laws they passed in recent years. I'm going to hope they win this one too.
